§4—209 of this subtitle and its revisor's
note. Subsection (e) has been revised to conform
more closely to the similar powers granted the
Maryland Port Administration in §6-204 (e) of
this article. As to this subsection, see,
also, Art. 15A, §§5 and 6 relating to gifts
and legacies received by a State agency. Subsection (f) of this section is added to
express the necessary power of the Authority
to adopt rules and regulations in the same
manner as the various Administrations and
other units in the Department. This power
would appear to be inherent in the transfer of
certain powers, including rulemaking powers,
from the State Roads Commission to the
Authority under former Art. 94A, §3 and former
Art. 41, §208C(b) and (c). (As to the
disposition of the former, see General
Revisor's Note to Title 3 of this article; as
to disposition of the latter, see General
Revisor's Note to this title.) As to subsection (b) of this section and the
disposition of State property, generally, see
Art. 78A, §§15 et seq. of the Code. As to subsection (d) of this section and its
reference to the employment of "attorneys",
see §2—104(e) of this article and the
revisor's note to that section. 4-206. POWER TO CONDEMN LAND FOR CERTAIN PURPOSES. SUBJECT TO TITLE 12 OF THE REAL PROPERTY ARTICLE AND
CH. 608, ACTS Of 1976, THE AUTHORITY MAY CONDEMN PROPERTY
FOR ANY TRANSPORTATION FACILITIES PROJECT AUTHORIZED TO BE FINANCED WITH REVENUE BONDS OF PRIOR ISSUES. REVISOR'S NOTE: This section is new language derived
from former Art. 89B, §§125 and 146. Although former Art. 89B, §§125 and 146
previously have been decodified by Ch. 608,
Acts of 1976 (see General Revisor's Note to
Title 3 of this article), this section is
included here to put the public on notice of
the power of condemnation for certain
projects, as transferred to the Authority from
the State Roads Commission (see, §4—209 of
this subtitle and its revisor's note). In addition to the projects enumerated in the
definition of "transportation facilities
project", this power of condemnation would
apply to a possible Northern Bay crossing
