AN ACT concerning
Scholarship Appointments — Senators and Delegates
FOR the purpose of providing for certain notifications to
be made within certain time frames concerning the
scholarship appointments of Senators and Delegates.
BY repealing and reenacting, with amendments,
Article 77A — Higher Education
Section 39
Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 39 of Article 77A - Higher
Education, of the Annotated Code of Maryland (1975
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:
Article 77A — Higher Education
39.
If the recipient of any award granted according to
the provisions of this subtitle shall withdraw from the
institution at which the award is used, or shall
otherwise cease to fulfill the requirements entitling him
to receive the award during the course of an academic
year, THE INSTITUTION SHALL NOTIFY THE STATE SCHOLARSHIP
BOARD WITHIN 30 DAYS OF THE WITHDRAWAL AND WITHIN [[30]]
TEN DAYS OF ITS NOTIFICATION THE STATE SCHOLARSHIP BOARD
SHALL NOTIFY THE APPOINTING AUTHORITY. [the] THE State
shall be entitled to receive from the institution a pro
rata refund according to the policy of the institution
with respect to refunds to students in the event of
withdrawal. Such refund shall be made to the State
Scholarship Board [,which shall immediately notify the
appointing authority concerned]. The appointing
authority shall then be entitled to make an interim
appointment, in accordance with the provisions of this
subtitle, except those requiring an examination; the
person so appointed shall be entitled to receive the
unused portion of the award only for the remainder of
that scholastic year, but shall not thereby be prevented
from receiving subsequent appointments according to the
provisions of this subtitle, including those requiring an
examination except that he shall not be required to take
an examination.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
