Ch. 316

GUARD WHO MEETS THE REQUIREMENTS OF THIS SECTION IS
ELIGIBLE TO RECEIVE FINANCIAL AID SUFFICIENT TO PROVIDE
REQUIRED BOOKS, FEES, AND TUITION FOR THE CHILD'S
SELECTED COURSE OF STUDY FOR A PERIOD NOT TO EXCEED FOUR
CONSECUTIVE YEARS.            FINANCIAL ASSISTANCE MAY NOT BE

PROVIDED UNDER THIS SECTION TO MEET THE COSTS OF MEALS,
LODGING, TRANSPORTATION, OH OTHER EXPENSES INCIDENT TO
ATTENDANCE AT COLLEGE WHILE LIVING AT HOME OR AWAY FROM
HOME.

(C)          AS A CONDITION TO CONTINUATION OF A CHILD'S
ELIGIBILITY FOR FINANCIAL ASSISTANCE UNDER THIS SECTION,
THE STUDENT SHALL MAINTAIN A TWO POINT OR "C" LETTER
AVERAGE.        IF A STUDENT FAILS TO ACHIEVE THIS AVERAGE FOR
A SEMESTER'S WORK HIS ELIGIBILITY TO RECEIVE FINANCIAL
ASSISTANCE UNDER THIS SECTION TERMINATES.

(D)         THE STATE SCHOLARSHIP BOARD SHALL ADOPT AND
PROMULGATE PULES AND REGULATIONS FOR DETERMINING (1)
WHETHER AN APPLICANT FOR ASSISTANCE WAS DEPENDENT ON THE
MEMBER OF THE NATIONAL GUARD AT THE TIME OF HIS DEATH, OR
AT THE TIME OF THE INJURY WHICH CAUSED THE MEMBER TO BE
TOTALLY INCAPABLE OF SELF-SUPPORT, WHICHEVER IS
APPLICABLE, AND (2) WHETHER A MEMBER WAS RENDERED TOTALLY
INCAPABLE OF SELF-SUPPORT.]]

BY repealing__and reenacting, with amendments,

Section 64(a)

Annotated Code of Maryland

(1975 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 64(a) of Article 77A - Higher

Education, of the Annotated Code of Maryland (1975

Replacement Volume and 1975 Supplement) be and it is

hereby repealed and reenacted, with amendments, to read
as follows:

Article 77A — Higher Education

64.

(a) Subject to the need criterion provided for in

subsection (c), (1) any child between the ages of 16 and
23 of any person who was a fireman, professional or
volunteer, a volunteer member of a rescue squad, or a

law-enforcement officer, of the State or any of its

political subdivisions, killed in the line of duty, OR

(2) A DEPENDENT LEGAL CHILD BY BIRTH OR ADOPTION OF A

MEMBER OF THE MARYLAND NATIONAL GUARD WHO WAS KILLED

WHILE ON ACTIVE DUTY IN SERVICE TO THE STATE OR FEDERAL

GOVERNMENT, if the deceased was a resident of the State

at the time he was killed, shall receive upon application

to the State Scholarship Board, State aid for tuition,

matriculation fees, board, room rent, books and supplies
