Section 130B, 130D, and 130E

Annotated Code of Maryland

(1972 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 130B of Article 56 - Licenses, of
the Annotated Code of Maryland (1972 Replacement Volume
and 1975 Supplement) be and it is hereby repealed.

SECTION 2. AND BE IT FURTHER ENACTED, That Section
130D of Article 56 — Licenses, of the Annotated Code of
Maryland (1972 Replacement Volume and 1975 Supplement) be
and it is hereby renumbered to be Section 130F.

SECTION 3. AND BE IT FURTHER ENACTED, That new
Sections 130B, 130D, and 130E be and they are hereby
added to Article 56 — Licenses, of the Annotated Code of
Maryland (1972 Replacement Volume and 1975 Supplement) to
read as follows:

Article 56 — Licenses

130B.

(A)   ALL APPLICATIONS FOR LICENSES SHALL BE FILED
WITH THE BOARD, AND THE APPLICANT SHALL REMIT A
NONREFUNDABLE INSPECTION FEE OF $25 WITH THE APPLICATION.

(B)   THE ANNUAL FEE FOR A LICENSE FOR ANY HORSE
RIDING STABLE WHERE FIVE OR LESS HORSES ARE MAINTAINED
FOR RENTAL PURPOSES SHALL BE $10. ALL OTHER ANNUAL
LICENSE FEES FOR HORSE RIDING STABLES SHALL BE $25. THE
ANNUAL INSPECTION FEE IS $25.

(C)    IF MORE THAN ONE INSPECTION IS NECESSARY IN
ANY LICENSING PERIOD, AN ADDITIONAL INSPECTION FEE OF $25
PER INSPECTION SHALL BE PAID BY THE LICENSEE. IF, AFTER
THREE INSPECTIONS, EXISTING DEFICIENCIES HAVE NOT BEEN
CORRECTED BY THE LICENSEE, THE BOARD SHALL BRING FORMAL
CHARGES AGAINST THE LICENSEE AND AN ADMINISTRATIVE
HEARING SHALL BE HELD IN ORDER TO DETERMINE IF THE
LICENSE SHOULD BE SUSPENDED OR REVOKED FOR ANY OF THE
REASONS LISTED IN SECTION 130C(B).

(D)   AN INSPECTION SHALL BE DEEMED NECESSARY IF
DURING A PREVIOUS INSPECTION DEFICIENCIES ARE FOUND AND
THE LICENSEE HAS NOT SUBMITTED EVIDENCE TO THE BOARD
WITHIN A REASONABLE PERIOD OF TIME THAT SATISFACTORY

CORRECTIVE MEASURES HAVE BEEN COMPLETED.
