Ch. 265

130D.

(A)    IF, PURSUANT TO ARTICLE 27, SECTION 67 OF THE
CODE, THE BOARD DEEMS IT NECESSARY TO TAKE POSSESSION OF
A HORSE IN ORDER TO PROTECT I? FROM NEGLECT OR CRUELTY,
THE BOARD IMMEDIATELY SHALL NOTIFY THE OWNER OR CUSTODIAN
OF SUCH ACTION.

(B)   THE OWNER OR CUSTODIAN OF THE HORSE MAY
PETITION THE BOARD FOR RETURN OF THE HORSE WITHIN FIVE
DAYS AFTER POSSESSION WAS TAKEN. IF A TIMELY PETITION IS
NOT FILED WITH THE BOARD, THE HORSE SHALL BE TREATED AS
AN ESTRAY.

(C)    IF THE OWNER OR CUSTODIAN FILES A TIMELY
PETITION, THE BOARD SHALL RETURN THE HORSE, PROVIDED THAT
THE OWNER OR CUSTODIAN CONSENTS TO PROVIDING PROPER
ATTENTION TO THE HORSE AS SPECIFIED BY THE BOARD, AND
PAYS ALL COSTS AND EXPENSES INCURRED IN THE TAKING OF
POSSESSION AND STABLING OF THE HORSE DURING POSSESSION.
OTHERWISE THE HORSE SHALL BE TREATED AS AN ESTRAY.

THE BOARD MAY APPLY FOR RELIEF BY INJUNCTION,
WITHOUT BOND, TO ENFORCE THE PROVISIONS OF THIS SUBTITLE
OR TO RESTRAIN ANY VIOLATIONS OF THEM. IN SUCH
PROCEEDINGS IT IS NOT NECESSARY TO ALLEGE OR PROVE EITHER
THAT AN ADEQUATE REMEDY AT LAW DOES NOT EXIST OR THAT
SUBSTANTIAL OR IRREPARABLE DAMAGE WOULD RESULT FROM THE
CONTINUED VIOLATIONS.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

Cooperative Associations

FOR the purpose of requiring certain annual audit
statements by certain cooperative associations to
directors and the Secretary of Agriculture and for
notification by the Secretary of Agriculture upon
finding of misrepresentation and to require such
reports of cooperative associations regardless of
state of incorporation or association if it has
