Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 111 of Article 27 - Crimes and
Punishments, of the Annotated Code of Maryland (1971
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 27 — Crimes and Punishments

111.

[Any person who shall wilfully and maliciously
destroy, injure, deface or molest any real or personal
property of another shall be deemed guilty of a
misdemeanor and, upon conviction thereof, shall be
subject to imprisonment for a period of not more than one
year or to a fine of not more than five hundred dollars
($500.00), or to both imprisonment and fine.] Any person
who shall wilfully and maliciously destroy, injure,
deface or molest any real or personal property of another

shall be deemed guilty of a misdemeanor and, upon

conviction thereof, shall be subject to imprisonment for
a period of not more than [one year] THREE YEARS OR to a
fine not more than [five hundred dollars ($500.00)]
$2,500, or to both imprisonment and fine.

[[SECTION 2. AND BE IT FURTHER ENACTED, That new
Section 111 be and it is hereby added to Article 27 —
Crimes and Punishments, of the Annotated Code of Maryland
(1971 Replacement Volume and 1975 Supplement) to read as
follows:

Article 27 — Crimes and Punishments

111.

(A) ANY PERSON WHO SHALL DESTROY, INJURE, DEFACE,
OR MOLEST WILFULLY AND WITH MALICE ANY REAL OR PERSONAL
PROPERTY OF ANOTHER WHERE THE COST OF REPLACING OR
RESTORING THE PROPERTY DESTROYED, INJURED, DEFACED OR
MOLESTED IS [[$500]] $2,500 OR MORE, IS GUILTY OF A
FELONY. UPON CONVICTION, THE PERSON IS SUBJECT TO
IMPRISONMENT FOR A PERIOD OF NOT MORE THAN TEN YEARS OR
TO A FINE OF NOT MORE THAN $10,000, OR TO BOTH FINE AND
IMPRISONMENT. IN ADDITION, THE TRIAL COURT MAY ORDER THE
CONVICTED PERSON TO REPLACE OR RESTORE TO ITS ORIGINAL
CONDITION THE PROPERTY DESTROYED, INJURED, DEFACED OR
