Section 245(c) of the Laws of
Maryland, or in accordance
with Article 43, Section 42D,
if allowable by the U.S. Depart-
ment of Health, Education and
Welfare for federal reimburse-
ment.
The schedule of payments establish-
ed by the State for payment to
such nursing homes shall not exceed,
including cost and profit factor of
no more than 6%, those established
by the Secretary of Health, Educa-
tion and Welfare in the administration
of Title XIX of the Social Security Act
as amended. Such schedules of payment
shall comply with the intent that upper
limits do not exceed amounts paid under
Title XVIII of the Social Security Act,
as amended, provided that such schedule
may vary in its specific elements if the
schedule does not jeopardize eligibility
for federal matching funds. Such pro-
vision shall apply to all categories of
recipients whether or not matched by
federal funds. Such facilities not sub-
mitting audited costs shall be reimbursed
at a rate not to exceed $7.00 per day, per
patient.
