the Commercial Law Article of the Code, or at retail, as
defined in [§ 10-501(i)] § 11-501(I) of the Commercial
Law Article of the Code, from a person not having a
license as provided for in § 66 of this article.

130.

There is hereby created a State Board of Inspection
of Horse Riding Stables, which shall be a part of the
Department of Licensing and Regulation, consisting of
three (3) members to be appointed by the Governor, with
the advice of the Secretary of Licensing and Regulation,
for four—year terms, one member shall be a duly qualified
and licensed veterinarian and one member shall be an
officer of a county humane society. The members of the
Board shall select their chairman. All the members of
the Board shall serve without compensation but shall be
allowed expenses incurred in the performance of their
duties in accordance with the standard travel
regulations. The exercise or performance of all powers,
authority, duties, and functions vested in the Board by
the provisions of this subtitle shall be subject to the
power and authority of the Secretary of Licensing and
Regulation as set forth in Article 41 of this Code, or
elsewhere in the laws of this State. All moneys
collected under this subtitle shall be paid over to the
Treasurer and shall become general funds of the State.
Such moneys shall thereafter be disbursed by the
Comptroller only pursuant to an appropriation made in
accordance with §§ 32 and 52 of Article 3 of the
Constitution or pursuant to the provisions of §§ 1
through 15, inclusive, of Article 15A, of this Code,
title "Budget and [Procurement] FISCAL PLANNING," as
amended from time to time.

(b) In St. Mary's County, a promoter may comply
with the provisions of [§ 159(b)(1)] § 159A(B) (1) of this
article by pledging real or personal property in lieu of
a cash bond, provided a verified financial statement is
submitted confirming that the fair market value of the
pledged property equals or exceeds the amount of the bond
required.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
