(c) [A] ANY person [violating the provisions] WHO
VIOLATES ANY PROVISION of this section is guilty of a
misdemeanor and[ , upon] ON conviction[, shall pay] IS
SUBJECT TO a fine [up to] NOT EXCEEDING $1,000 for each
offense.
SECTION 3. AND BE IT FURTHER ENACTED, That Sections
3-131, 8-1602, 8-1603, 8-1604, and 8-1605 of Article -
Natural Resources, of the Annotated Code of Maryland
(1974 Volume and 1975 Supplement) be and they are hereby
repealed and reenacted, with amendments, to read as
follows:
Article — Natural Resources
3-131.
Any person [violating] WHO VIOLATES any provision of
this subtitle[,] or OF any rule or regulation
[promulgated] ADOPTED by the Service is guilty of a
misdemeanor and [upon] ON conviction is subject to a fine
not exceeding $1,000 for each violation. A separate
offense [shall exist] EXISTS for each day a violation
occurs.
8-1602.
[It is unlawful for any] A person[, firm, or
corporation, to] MAY NOT dump, deposit, or scatter in an
unconfined manner spoil from Baltimore Harbor, into or
onto any portion of the water or bottomland of the
Chesapeake Bay or of the tidewater portions of any of its
tributaries outside of Baltimore Harbor [provided that].
HOWEVER, the spoil may be redeposited in contained areas
approved by the Department [of Natural Resources].
8-1603.
The Attorney General of Maryland or the State's
attorney of any county of this State [which] THAT borders
[upon] ON a portion of the Chesapeake Bay or [upon] ON a
tidewater portion of any of its tributaries may seek an
injunction against any person[ , firm, or corporation,]
violating or threatening to violate any [provisions]
PROVISION of this subtitle.
8-1604.
The Attorney General of Maryland or the State's
attorney of any county of this State [which] THAT borders
[upon] ON a portion of the Chesapeake Bay or [upon] ON a
tidewater portion of any of its tributaries may enforce
[the provisions of] this subtitle and MAY seek criminal
penalties against any person[, firm, or corporation,
violating] WHO VIOLATES or IS alleged to be violating §
8-1602 of this subtitle anywhere in the area of the
