the County Council shall exercise its legislative
review and oversight responsibilities; to set forth
findings by the County Council with respect to this
Act; to state the purpose of this Act; to establish
within the Legislative Branch of County government
an Office of Legislative Oversight; to provide for
appointment of personnel to staff the Office of
Legislative Oversight; to state the powers, duties
and responsibilities of the Office of Legislative
Oversight; to provide that the Office of Legislative
Oversight, shall conduct its activities in accordance
with a work program to be approved by the County
Council; to provide that the Office of Legislative
Oversight shall have access to certain records and
information to carry out its duties and
responsibilities under this Act; to set forth the
power of the County Council to summon witnesses and
to administer oaths and affirmations in connection
with audits, surveys and investigations conducted
pursuant to this Act; to require that, subject to
certain exceptions, reports made of audits, surveys
or investigations conducted under this Chapter shall
be made available to the general public; to specify
that all reports or parts of reports except those
that contain information that would not be available
for public inspection pursuant to Article 76A of the
Annotated Code of Maryland shall be made public as
part of the local legislative review and oversight
process; to specify penalties for failure to comply
with valid requests for information and subpoena of
witnesses made pursuant to this Act, for knowingly
giving false or misleading information in connection
with any audit, survey or investigation conducted
pursuant to this Act, and for retaliation or
threatened retaliation against any person who
provides information to or otherwise cooperates with
the Office of Legislative Oversight.
Chapter 19
AN ACT to repeal and re-enact with amendments, Section
48—32, title "Imposition; amount; exemptions", of
Chapter 48, title "Solid Wastes", of the Montgomery
County Code 1972, as amended, to provide that the
base refuse disposal charge to be established by
resolution of the County Council may be changed at
any time by resolution of the County Council
following notice and public hearing on such changes;
and to provide that the effective date of any change
in the base refuse disposal charge shall provide
adequate time to allow public and private agencies
and organizations to make necessary billing
adjustments.
