COUNTY LOCAL LAWS

"Construction by county."; subsections (a) and (b)
of Section 49—40, title "Performance bond."; Section
49—52; title "Road construction to be authorized by
county executive; council to assess benefits."; to
add two new subsections (d) and (e); and Section
49-55 title "Assessment of cost by county council."
of Chapter 49, title "Streets and Roads," Montgomery
County Code 1972, to provide for an increase in
frontage from seventy (70) to eighty (80) feet where
sidewalks, curbs and gutters are not required; to
provide for the assessment of all costs of
construction including cost of right—of—way
acquisitions up to amount of special benefit; to
authorize the construction of bikeways to serve
general community needs by the County without regard
to standards and specifications; to provide for a
release of cash and corporate performance bonds by
stages; to provide for a presumption of no benefit
for street assessment cost for property improved or
unimproved which is zoned residential and is not
developed or master planned for institutional,
multiple family, industrial, or commercial use,
abuts a County maintained two—lane capacity, paved
roadway and is incapable of subdivision into more
than two additional residential lots; to provide
that assessments may be waived against properties
for roads undertaken by the County within the
boundaries of, or for urban renewal projects,
community redevelopment projects and neighborhood
improvement projects approved in the Capital
Improvements Programs for the purpose of eliminating
and preventing blight, slums, or deterioration of a
neighborhood or designated area; and to set forth
certain time limitations.

Chapter 17

ACT to add to Chapter 12, title "Courts," of the
Montgomery County Code 1972, as amended, a new
Section 12-8A, title "Appellate judges' secretaries;
salary supplements," to authorize judges of the
Maryland appellate courts resident in Montgomery
County to set within certain limits supplements to
the State salaries for their secretaries, which
supplements shall be paid from funds appropriated
therefor by the County Council.

Chapter 18

ACT to add to the Montgomery County Code 1972, as

amended, a new Chapter 29A, title "Legislative

Oversight", to establish a procedure through which
