(B) THE BOARD CONSISTS OF [[SEVEN]] NINE MEMBERS
OF WHOM ONE MEMBER SHALL BE A REPRESENTATIVE OF THE
AMUSEMENT RIDE MANUFACTURERS, ONE SHALL BE A
REPRESENTATIVE OF THE CARNIVAL OWNERS, [[ONE]] TWO SHALL
BE A REPRESENTATIVE OF THE AMUSEMENT PARK OWNERS, ONE
SHALL BE A REPRESENTATIVE OF THE STATE OR COUNTY FAIRS,
ONE SHALL BE A MECHANICAL ENGINEER AND [[TWO]] THREE
SHALL REPRESENT THE PUBLIC AND ONE OF THE PUBLIC MEMBERS
SHALL BE DESIGNATED THE CHAIRMAN. THE MEMBERS OF THIS
BOARD SHALL BE APPOINTED BY THE GOVERNOR WITH THE ADVICE
AND CONSENT OF THE SENATE FOR A TERM OF SIX YEARS, EXCEPT
OF THE FIRST MEMBERS APPOINTED, OF THOSE REPRESENTING THE
AMUSEMENT RIDE MANUFACTURERS, CARNIVAL OWNERS, AMUSEMENT
PARK OWNERS AND STATE AND COUNTY FAIRS, ONE SHALL BE
APPOINTED FOR THREE YEARS, ONE SHALL BE APPOINTED FOR
FOUR YEARS, ONE SHALL BE APPOINTED FOR FIVE YEARS AND ONE
SHALL BE APPOINTED FOR SIX YEARS AND THE MECHANICAL
ENGINEER AND, OF THOSE MEMBERS REPRESENTING THE PUBLIC,
ONE SHALL BE APPOINTED FOR FOUR YEARS, ONE SHALL BE
APPOINTED FOR FIVE YEARS AND ONE SHALL BE APPOINTED FOR
SIX YEARS, ALL MEMBERS TO SERVE UNTIL THEIR SUCCESSORS
ARE APPOINTED AND QUALIFIED AND SUCH APPOINTMENTS ARE
APPROVED BY THE SENATE. VACANCIES SHALL BE FILLED BY THE
APPOINTMENT FOR THE UNEXPIRED TERM BY THE GOVERNOR WITH
THE ADVICE AND CONSENT OF THE SENATE IN THE SAME MANNER
AS THE ORIGINAL APPOINTMENTS. THE MEMBERS OF THE BOARD
SHALL RECEIVE THE COMPENSATION PROVIDED IN THE BUDGET AND
SHALL BE REIMBURSED FOR ACTUAL EXPENSES. THE MEMBERS OF
THE BOARD ARE ELIGIBLE FOR REAPPOINTMENT.
70.
(A) THE BOARD SHALL ADVISE, CONSULT WITH AND MAKE
RECOMMENDATIONS AND PROPOSE SUCH REASONABLE RULES,
REGULATIONS AND STANDARDS, OR THEIR MODIFICATIONS,
AMENDMENTS, OR REVOCATIONS, TO THE COMMISSIONER FOR THE
PREVENTION OF CONDITIONS DETRIMENTAL TO THE PUBLIC IN THE
USE OF AMUSEMENT RIDES AND ATTRACTIONS AS THE BOARD FINDS
NECESSARY FOR THE PROTECTION AND SAFETY OF THE PUBLIC
UPON THE BASIS OF CIRCUMSTANTIAL EVIDENCE AND INFORMATION
AVAILABLE TO OR DEVELOPED BY THE COMMISSIONER, OR UPON
CIRCUMSTANTIAL EVIDENCE AND INFORMATION SUBMITTED BY ANY
INTERESTED PERSON AT A PUBLIC HEARING HELD IN ACCORDANCE
WITH SUBSECTION (C) OF THIS SECTION. THE COMMISSIONER
MAY MAKE SUCH RECOMMENDATIONS TO THE BOARD REGARDING
RULES, REGULATIONS AND STANDARDS, OR THEIR MODIFICATIONS,
AMENDMENTS, OR REVOCATIONS AS HE DEEMS NECESSARY TO CARRY
OUT THE INTENT OF THIS ACT.
(B) THE BOARD SHALL HOLD PUBLIC HEARINGS REQUIRED
TO CARRY OUT ITS RESPONSIBILITIES UNDER THIS SUBTITLE.
ANY PUBLIC HEARING OF THE BOARD SHALL BE HELD AT SUCH
TIME AND PLACE AS THE BOARD SHALL SPECIFY. NOTICE OF IT
SHALL BE PUBLISHED AT LEAST ONCE, NOT LESS THAN 15 DAYS
BEFORE THE HEARING IN THE MARYLAND REGISTER.
