(3) CONDUCT INSPECTIONS AND INVESTIGATIONS
IN ACCORDANCE WITH THIS SUBTITLE;

SUBTITLE;
SUBTITLE;

(4)    ISSUE CITATIONS IN ACCORDANCE WITH THIS

(5)    PERMIT VARIANCES IN ACCORDANCE WITH THIS

(6)     PROMULGATE RULES OF PROCEDURES FOR
HEARINGS HELD IN ACCORDANCE WITH THIS SUBTITLE;

(7)    IMPOSE CIVIL PENALTIES IN ACCORDANCE
WITH THIS SUBTITLE; AND

(8)    ESTABLISH RECORD KEEPING AND REPORTING
PROCEDURES AS ARE NECESSARY TO CARRY OUT HIS DUTIES
CREATED BY THIS SUBTITLE.

(B)     (1) THE COMMISSIONER OR HIS AUTHORIZED
REPRESENTATIVE, HAS THE POWER TO ADMINISTER OATHS,
CERTIFY AS TO OFFICIAL ACTS, TAKE AND CAUSE TO BE TAKEN
DEPOSITION OF WITNESSES, ISSUE SUBPOENAS, AND COMPEL THE
ATTENDANCE OF WITNESSES AND PRODUCTION OF PAPERS, BOOKS,
DOCUMENTS, RECORDS AND TESTIMONY.

(2) IF A PERSON DOES NOT COMPLY WITH A
SUBPOENA ISSUED BY THE COMMISSIONER, A COURT OF COMPETENT
JURISDICTION , ON APPLICATION OF THE COMMISSIONER OR HIS
AUTHORIZED REPRESENTATIVE, IN A PROCEEDING FOR CONTEMPT
MAY COMPEL THE PERSON TO COMPLY WITH THE SUBPOENA.

(C)    (1) THE COMMISSIONER MAY DELEGATE HIS POWER
OF INSPECTION TO ANY OTHER DEPARTMENT OR AGENCY OF THE
STATE OR ANY POLITICAL SUBDIVISION OR MUNICIPALITY IN THE
STATE.

(2) HOWEVER, IF A POLITICAL SUBDIVISION
PRESENTS SATISFACTORY EVIDENCE TO THE COMMISSIONER THAT
IT CAN PERFORM THE INSPECTIONS REQUIRED BY THE PROVISIONS
OF THIS ACT. THE COMMISSIONER SHALL DELEGATE HIS POWER OF
INSPECTION.

[[(2)]] (3) THE DELEGATION OF POWER IS SUBJECT
TO THE AGREEMENT ENTERED INTO BY THE COMMISSIONER AND THE
DEPARTMENT, AGENCY, POLITICAL SUBDIVISION, OR
MUNICIPALITY.

[[(3)]] (4) THE COMMISSIONER MAY:

(I)    REVOKE THE AGREEMENT;

(II)   RETAIN THE RIGHT TO MONITOR THE
INSPECTION.
