Article 41 - Governor — Executive and Administrative

206D.
(A) THE POSITION OF ASSISTANT SECRETARY FOR MENTAL
HEALTH AND ADDICTIONS IS CREATED WITHIN THE DEPARTMENT OF
HEALTH AND MENTAL HYGIENE. THE ASSISTANT SECRETARY SHALL
BE APPOINTED BY THE SECRETARY OF HEALTH AND MENTAL
HYGIENE AND SHALL SERVE AT THE PLEASURE OF THE SECRETARY.
THE ASSISTANT SECRETARY SHALL HAVE THE MINIMUM
QUALIFICATIONS OF A BACCALAUREATE DEGREE AND EXPERIENCE
IN HEALTH ADMINISTRATION.
(B) NOTWITHSTANDING ANY LAW OR REGULATION TO THE
CONTRARY, THE ASSISTANT SECRETARY IS RESPONSIBLE TO THE
SECRETARY OF HEALTH AND MENTAL HYGIENE FOR ALL OF THE
FUNCTIONS, ADMINISTRATION, AND OPERATION OF THE MENTAL
HYGIENE, DRUG ABUSE, AND ALCOHOLISM CONTROL
ADMINISTRATIONS, PROVIDED BY LAW OR BY RULES OR
REGULATIONS OF THE DEPARTMENT OF HEALTH AND MENTAL
HYGIENE.
(C) THE ASSISTANT SECRETARY HAS THE SALARY
PROVIDED IN THE ANNUAL STATE BUDGET.
(D) NOTWITHSTANDING ANY LAW OR REGULATION TO THE
CONTRARY, ALL EDUCATIONAL AND TRAINING FUNCTIONS OF THE
DRUG ABUSE, AND ALCOHOLISM CONTROL ADMINISTRATIONS SHALL
BE ADMINISTERED IN THE OFFICE OF THE ASSISTANT SECRETARY
BY A DIRECTOR OF EDUCATION AND TRAINING.
SECTION 2. AND BE IT FURTHER ENACTED, That Sections
103 and 301(a) of Article 2C - Alcoholism, of the
Annotated Code of Maryland (1968 Replacement Volume and
1975 Supplement) be and it is hereby repealed and
reenacted, with amendments, to read as follows:
Article 2C — Alcoholism
103.
(a) The term "Department," as used in this
[subtitle] ARTICLE, means the State Department of Health
and Mental Hygiene.
(B) THE TERM "DIVISION OF ALCOHOLISM CONTROL" OR
"DIVISION" MEANS THE ALCOHOLISM CONTROL ADMINISTRATION.
[(b)](C) The term "chronic alcoholic" means any
person who chronically and habitually uses alcoholic
beverages (1) to the extent that it injures his health or
substantially interferes with his social or economic
functioning, or (2) to the extent that he has lost the
power of self—control with respect to the use of such
beverages.
