(v) Official and "on—premise" signs, as defined in §
131 (c) of Title 23, United States Code, shall not be
counted nor shall measurements be made from them for
purposes of determining compliance with the above spacing
requirements.
(vi) The minimum distance between signs shall be
measured along the nearest edge of the pavement between
points directly opposite the signs. Minimum spacing
criteria specified above for all highways shall not apply
for sign structures separated by a building or other
obstruction so that only one sign structure is visible
from any one place on the main—traveled way.
(d) Lighting: Signs may be illuminated, subject to
the following restrictions;
(i) Signs which contain, include, or are illuminated
by any flashing, intermittent, or moving light or lights
are prohibited, except those giving public service
information such as time, date, temperature, weather, or
similar information.
(ii) Signs which are not effectively shielded as to
prevent beams or rays of light from being directed at any
portion of the traveled ways of the federal—aid primary
highway and which are of such intensity or brilliance as
to cause glare or to impair the vision of the driver of
any motor vehicle, or which otherwise interfere with any
driver's operation of a motor vehicle are prohibited.
(iii) No sign shall be so illuminated that it
interferes with the effectiveness of, or obscures an
official traffic sign, device, or signal.
(iv) All such lighting shall be subject to any other
provisions relating to lighting of signs presently
applicable to all highways under the jurisdiction of the
State.
(e) This section shall not apply to the erection or
maintenance of any school bus waiting shelter displaying
outdoor advertising signs provided the outdoor
advertising does not exceed thirty—two (32) square feet
in area, has no more than one sign facing in one
direction and is limited to not more than two (2) signs
per shelter. All outdoor advertising on school bus
shelters shall be subject to applicable local zoning
regulations and standards promulgated by the State which
are consistent with the code of federal regulations
regarding national standards for outdoor advertising on
interstate and federally aided primary systems of
highways.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
