(c-1) WICOMICO COUNTY - IN WICOMICO COUNTY, NO BEER,
WINE AND LIQUOR, CLASS A (OFF-SALE) SHALL BE ISSUED TO AN
INDIVIDUAL OR PARTNERSHIP UNLESS THEY HAVE BEEN BONA FIDE
RESIDENTS OF THE COUNTY FOR TWO YEARS NEXT PRECEDING THE
APPLICATION FOR EITHER LICENSE. NO BEER, WINE AND LIQUOR

LICENSE, CLASS A (OFF-SALE) SHALL BE ISSUED TO ANY

CORPORATION UNLESS THE APPLICANTS (1) OWN OR ARE OWNERS

OF 75 PERCENT OF THE TOTAL ISSUED CAPITAL STOCK OF THE
CORPORATION, AND (2) ARE BONA FIDE RESIDENTS OF WICOMICO

COUNTY FOR TWO YEARS NEXT PRECEDING THE APPLICATION FOR

EITHER LICENSE.

(K) WICOMICO COUNTY - THE PROVISIONS OF
SUBSECTIONS (A) AND (A-1) OF THIS SECTION DO NOT APPLY TO

LICENSES ISSUED UNDER SECTION 19 OF THIS ARTICLE IF: (1)

THE RESIDENT APPLICANT HAS BEEN A RESIDENT OF WICOMICO

COUNTY FOR AT LEAST TWO YEARS PRIOR TO THE APPLICATION,

AND (2) THE MINIMUM CAPITAL INVESTMENT IN THE PREMISES IS
AT LEAST $200,000 OR THE PREMISES HAVE A FAIR MARKET
VALUE OF AT LEAST $200,000.

(L) NOTWITHSTANDING ANY OTHER PROVISION OF THIS
SECTION, WICOMICO COUNTY MAY ISSUE AN ADDITIONAL CLASS A
BEER, WINE AND LIQUOR LICENSE FOR ANY PREMISE REQUIRED
UNDER A CLASS B BEER, WINE AND LIQUOR LICENSE, UPON THE
PAYMENT OF THE PRESCRIBED FEES FOR EACH CLASS OF LICENSE.
THE AREA OF THE LICENSED PREMISES NORMALLY USED AS A
RESTAURANT FOR THE PREPARATION AND CONSUMPTION OF FOOD
AND BEVERAGES ON THE PREMISES WAY OCCUPY NO LESS THAN 80
PERCENT OF THE SQUARE FOOT AREA.

(D) IN WICOMICO COUNTY, THE COUNTY DISPENSARIES
SHALL MAKE WHOLESALE SALES OF ALL [[WINES AND]] LIQUORS
AT A MARK UP OF NOT [[NORE]] MORE THAN 15 PERCENT ABOVE
THE OPERATING COST TO THE DISPENSARY TO ANY LICENSEE OF A
CLASS A, B, OR C [[OR D BEER AND LIGHT WINE OR]] BEER,
WINE AND LIQUOR LICENSE.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
