Natural Resources — Safe Disposal of Hazardous Substances
FOR the purpose of controlling the discharge of hazardous
substances, [[including waste]]; providing for
adoption of certain regulations; establishing the
Hazardous Substance Advisory Council and defining
its duties; establishing the Maryland Hazardous
Substance Control Fund for certain purposes;
confining the disposal of hazardous substances to
certain facilities; providing for permits and
certificates for those engaged in [[generation,
utilization,]] transportation and disposal of
dangerous substances; providing for condemnation of
land under certain conditions; defining certain
terms; and generally relating to a safe disposal of
[[dangerous]] hazardous substances.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section [[8-1413.1]] 8-1413.2 be and
it is hereby added to Article — Natural Resources, of the
Annotated Code of Maryland (1974 Volume and 1975
Supplement) to read as follows:

(A) IN THIS SECTION THE FOLLOWING WORDS AND
PHRASES HAVE THE MEANINGS INDICATED.
(1) "COUNCIL" MEANS THE HAZARDOUS SUBSTANCE
ADVISORY COUNCIL.
(2) "DESIGNATED HAZARDOUS SUBSTANCE" MEANS A
SUBSTANCE IDENTIFIED AS A HAZARDOUS SUBSTANCE BY THE
DEPARTMENT PURSUANT TO THIS SECTION.
[[(2)]] (3) "FACILITY" MEANS A DISPOSAL
STRUCTURE, SYSTEM, OR GEOGRAPHIC AREA DESIGNATED BY THE
DEPARTMENT FOR TREATMENT, STORAGE RELATED TO TREATMENT OR
DISPOSAL, OR DISPOSAL OF DESIGNATED HAZARDOUS SUBSTANCES.
[[(3)]] (4) "FUND" MEANS THE MARYLAND
HAZARDOUS SUBSTANCE CONTROL FUND.
[[(4)]] (5) "HAZARDOUS SUBSTANCE" MEANS ANY
MATTER THAT CONVEYS TOXIC, LETHAL, OR SUBLETHAL EFFECTS
TO PLANT, AQUATIC, OR ANIMAL LIFE, OR WHICH MAY BE
INJURIOUS TO HUMAN HEALTH, OR PERSISTS IN THE
