established, shall become a part of the State program of
public education [as provided for elsewhere in this
article]. The county board of education, with the advice
of the COUNTY superintendent of schools, shall determine
the geographical attendance areas for all such schools
established under the provisions of this section.
43.
The county boards of education, in accordance with
the APPLICABLE rules and regulations of the State Board
[of Education], may establish and maintain day and
evening schools for adults, the purpose of which shall be
to provide a general program of continuing education in
all its aspects for the improvement of the civic,
vocational, and general intelligence of adults, and to
enable them to make a wise use of their leisure time.
45.
Real and personal estate granted, conveyed, devised
or bequeathed for the use of any particular PUBLIC school
or school system shall be held in trust by the boards of
education, OR, IN BALTIMORE CITY, BY THE MAYOR AND CITY
COUNCIL, for the benefit of such school or school system,
and such grants and bequests shall be exempt from all
State and local taxes.
54.
The county board of education shall appoint, on the
written recommendation of the county superintendent of
schools, all principals, teachers, and all other
certificated and noncertificated personnel, and fix their
salaries, subject to the provisions of this article. IN
BALTIMORE CITY, THE BOARD OF SCHOOL COMMISSIONERS SHALL
EXERCISE THE AUTHORITY GRANTED IN THIS SECTION, EXCEPT
WITH RESPECT TO NONCERTIFICATED PERSONNEL, WHOSE
APPOINTMENT AND SALARIES SHALL BE DETERMINED IN
ACCORDANCE WITH THE BALTIMORE CITY CHARTER.
58.
The county superintendent of schools, as the
executive officer of the county board of education, shall
see that the laws relating to the schools, the APPLICABLE
enacted and published bylaws and the policies of the
State Board [of Education], and the rules and regulations
and the policies of the county board of education are
carried into effect.
59.
The county superintendent of schools shall explain
the true intent and meaning of the school law, and of the
APPLICABLE bylaws of the State Board [of Education]. He
shall decide, subject to the provisions of § 160 of this
article, without expense to the parties concerned, all
