SUPERINTENDENT shall be the chief executive, the
secretary, and the treasurer of the State Board [of
Education]. He shall attend all meetings of the Board
and of its committees, except when his own tenure,
salary, or the administration of his office are under
consideration, and shall have the right to advise on any
question under consideration, but shall have no right to
vote. HE SHALL BE A MEMBER OF THE GOVERNOR'S EXECUTIVE
COUNCIL.

7.

The State Board [of Education] shall exercise,
through the [State Superintendent of Schools]
[[COMMISSIONER]] STATE SUPERINTENDENT and his
professional assistants, general control and supervision
over the public schools and educational interest of the
State[; and they]. THE STATE BOARD shall consult with
and advise, through the [State Superintendent]
[[COMMISSIONER]] STATE SUPERINTENDENT and his
professional assistants, county boards of education,
county superintendents and their staffs, principals,
teachers, and interested citizens, and shall seek in
every way to direct and develop public sentiment in
support of public education. THE AUTHORITY GRANTED IN
THIS SECTION APPLIES WITH RESPECT TO BALTIMORE CITY
EXCEPT TO THE EXTENT THAT IT PERTAINS TO MATTERS WHICH
ARE THE SUBJECT OF OTHER PROVISIONS OF THIS ARTICLE THAT
ARE NOT APPLICABLE TO BALTIMORE CITY.

41.

The county board of education shall to the best of
its ability cause the provisions of this article, the
APPLICABLE bylaws, rules and regulations, and the
policies of the State Board [of Education] to be carried
into effect. Subject to this article, and to the
APPLICABLE bylaws, rules and regulations of the State
Board [of Education], the county board of education shall
determine, with the advice of the county superintendent,
the educational policies of the county school system and
shall prescribe rules and regulations for the conduct and
management of the public schools in the said county
school system. [Such] THESE rules and regulations shall
be codified and made available to the public.

42.

The county boards of education [shall have authority
to] MAY establish public schools when, in their judgment,
it is advisable to do so, subject to the approval of the
[State Superintendent of Schools, according to]
[[COMMISSIONER]] STATE SUPERINTENDENT AND IN ACCORDANCE
WITH the APPLICABLE bylaws, rules and regulations of the
State Board [of Education], Upon approval by the [State
Superintendent of Schools] [[COMMISSIONER]] STATE
SUPERINTENDENT, any elementary or high school, or any
school or combination of any grades thereof, so
