Ch. 539

RESIDENTIAL INSTITUTIONS SHALL BE AS PROVIDED IN THE
STATE BUDGET FOR THE STATE DEPARTMENT OF [[ELEMENTARY AND
SECONDARY]] EDUCATION. HOWEVER, THE DEPARTMENT OF HEALTH
AND MENTAL HYGIENE AND OTHER STATE AGENCIES MAY
CONTRIBUTE TO THE PROGRAM, AS PROVIDED IN THE STATE
BUDGET. FUNDS APPROPRIATED FOR EDUCATIONAL PROGRAMS IN
STATE HOSPITAL CENTERS AND JUVENILE RESIDENTIAL
INSTITUTIONS MAY NOT BE DIVERTED, BY BUDGET AMENDMENT OR
OTHERWISE, TO ANY OTHER PURPOSE.

(G) THE STATE DEPARTMENT OF [[ELEMENTARY AND
SECONDARY]] EDUCATION SHALL PROVIDE TECHNICAL ASSISTANCE
AND SUPPORT TO THE COUNCIL AND TO THE DEPARTMENT OF
HEALTH AND MENTAL HYGIENE IN THE DEVELOPMENT AND
OPERATION OF EDUCATIONAL PROGRAMS IN STATE HOSPITAL
CENTERS AND JUVENILE RESIDENTIAL INSTITUTIONS.

220. JURISDICTION OF OTHER AGENCIES NOT AFFECTED.

NOTHING IN SECTIONS 218 AND 219 SHALL AFFECT THE
JURISDICTION OF THE STATE BOARD [[FOR ELEMENTARY AND
SECONDARY]] OF EDUCATION, THE [[COMMISSIONER OF
ELEMENTARY AND SECONDARY EDUCATION]] STATE SUPERINTENDENT
OF SCHOOLS, THE STATE BOARD FOR HIGHER EDUCATION, OR THE
COMMISSIONER OF HIGHER EDUCATION, OTHERWISE PROVIDED BY
LAW.

SECTION 3. AND BE IT FURTHER ENACTED, That Sections
4, 5, 7, 41, 42, 43, 45, 54, 58, 59, 61, 65, 68(a), 72,
123, 143, 154, 155, 156, 157, 159, 160A(a) and 167(b) of
Article 77 - Public Education, of the Annotated Code of
Maryland (1975 Replacement Volume and 1975 Supplement) be
and they are hereby repealed and reenacted, with
amendments, to read as follows:

Article 77 — Public Education

4.

(A)    The State Board of Education shall hold an
annual meeting in July at which the Board shall each year
select one of its members to serve as president, one to
serve as vice—president, and shall hold at least three
other regular meetings during the year. The Board may
hold such special meetings as its duties and business may
require.

(B)    A MEMBER MAY SERVE NO MORE THAN FIVE YEARS AS
PRESIDENT.

5.

The members of the State Board [of Education] shall
receive no salary, but their traveling and other
necessary expenses incurred in attending the meetings and
transacting the business of the Board shall be paid in
accordance with the standard travel regulations. The
[State Superintendent of Schools] [[COMMISSIONER]] STATE
