HEALTH AND MENTAL HYGIENE IS LOCATED, WHO SHALL BE
SELECTED FROM TIME TO TIME BY THE [[COMMISSIONER OF
ELEMENTARY AND SECONDARY EDUCATION]] STATE SUPERINTENDENT
OF SCHOOLS; AND
(8) FIVE PERSONS APPOINTED BY THE GOVERNOR
FROM THE PUBLIC AT LARGE, MHO MAY NOT BE EMPLOYEES OF ANY
AGENCY OF STATE OR LOCAL GOVERNMENT. THESE PERSONS SERVE
FOR A TERM OF FIVE YEARS AND UNTIL THEIR SUCCESSORS
QUALIFY, AND ARE ELIGIBLE FOR REAPPOINTMENT. HOWEVER, A
PERSON APPOINTED FROM THE PUBLIC AT LARGE MAY NOT SERVE
MORE THAN TWO FULL FIVE YEAR TERMS AS A MEMBER OF THE
COUNCIL. OF THE INITIAL APPOINTEES, ONE SHALL SERVE AN
INITIAL TERM OF FIVE YEARS; ONE SHALL SERVE AN INITIAL
TERM OF FOUR YEARS; ONE SHALL SERVE AN INITIAL TERM OF
THREE YEARS; ONE SHALL SERVE AN INITIAL TERM OF TWO
YEARS; AND ONE SHALL SERVE AN INITIAL TERM OF ONE YEAR.
THESE PERSONS MAY NOT RECEIVE COMPENSATION FOR THEIR
SERVICE BUT SHALL RECEIVE REIMBURSEMENT FOR THE NECESSARY
AND REASONABLE EXPENSES INCURRED IN THE PERFORMANCE OF
THEIR DUTIES, AS PROVIDED IN THE STATE BUDGET.
(C) EXCEPT FOR PERSONS FROM THE PUBLIC AT LARGE, A
MEMBER MAY APPOINT A DESIGNEE TO SERVE ON THE COUNCIL.
(D) THE COUNCIL SHALL PLAN AND DEVELOP AN
EDUCATIONAL PROGRAM TO BE CONDUCTED IN EACH STATE
HOSPITAL CENTER AND JUVENILE RESIDENTIAL INSTITUTION
WITHIN THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE, AND
SHALL MONITOR THE PROGRAM'S OPERATION. EACH EDUCATIONAL
PROGRAM SHALL TAKE ACCOUNT OF THE SPECIAL NEEDS AND
CIRCUMSTANCES OF THE PATIENTS, INMATES, AND PERSONNEL IN
THE CENTER OR INSTITUTION, AND SHALL BE COORDINATED WITH
THE OVERALL OPERATION AND FUNCTION OF THE CENTER OR
INSTITUTION AND WITH EDUCATIONAL PROGRAMS OFFERED IN THE
PUBLIC SCHOOL SYSTEMS. THE COUNCIL SHALL REPORT BEFORE
JULY 1 OF EACH YEAR TO THE GOVERNOR AND THE GENERAL
ASSEMBLY CONCERNING THE OPERATION OF THE EDUCATIONAL
PROGRAM IN EACH CENTER AND INSTITUTION.
(E) THE SECRETARY OF HEALTH AND MENTAL HYGIENE
SHALL APPOINT A DIRECTOR OF EDUCATIONAL PROGRAMS WITHIN
THE DEPARTMENT OF HEALTH AND MENTAL HYGIENE, WHO SHALL
RECEIVE THE SALARY PROVIDED IN THE STATE BUDGET FOR THE
DEPARTMENT OF HEALTH AND MENTAL HYGIENE. THIS PERSON IS
RESPONSIBLE FOR THE APPROPRIATE IMPLEMENTATION AND
OPERATION OF THE EDUCATIONAL PROGRAMS IN STATE HOSPITAL
CENTERS AND JUVENILE RESIDENTIAL INSTITUTIONS AS
DEVELOPED BY THE COUNCIL, AND SHALL MEET WITH AND ADVISE
THE COUNCIL WITH RESPECT TO THESE PROGRAMS. HE SHALL
SUPERINTEND THESE PROGRAMS IN CONSULTATION WITH THE
DIRECTOR OF THE JUVENILE SERVICES ADMINISTRATION, THE
COMMISSIONER OF MENTAL HYGIENE, THE DIRECTOR OF THE
MENTAL RETARDATION ADMINISTRATION, AND THE RESPECTIVE
SUPERINTENDENTS OF THE CENTERS AND INSTITUTIONS.
(F) FUNDS FOR THE OPERATION OF THE EDUCATIONAL
PROGRAM IN STATE HOSPITAL CENTERS AND JUVENILE
