Ch. 538

least six of the members first appointed shall be
selected from the present board of trustees of Morgan
State College, In case of a vacancy from death,
resignation or otherwise, the Governor shall appoint a
person to fill the unexpired term of the member causing
the vacancy.

SECTION 4.        AND BE IT FURTHER ENACTED, That all

employees of the Maryland Council for Higher Education
shall be transferred to and become employees of the State
Board for Higher Education, without any diminution in
salary or benefits; all property, funds, assets,
liabilities, contracts, documents, and records of the
Council shall be transferred to and become the property,
funds, assets, liabilities, contracts, documents, and
records of the State Board for Higher Education; all
rules, regulations, orders, and directives of the Council
shall remain in effect until changed by the State Board
for Higher Education in accordance with law; and all
references in the Annotated Code of Maryland and any
other law, ordinance, by—law, rule, regulation, order,
directive, or document to the Maryland Council for Higher
Education shall be [[deemend]] deemed to refer to the
State Board for Higher Education.

SECTION 5. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.

AN ACT concerning

Elementary and Secondary Education

FOR the purpose of generally revising the structure and
governance of elementary and secondary education in

the State; limiting the__term of office of the

president of the State Board of Education;

[[changing the name of the State Board of Education
and]] revising [[its]] the size, composition, duties

and procedures of the State Board of Education;

including Baltimore City within certain provisions
of Article 77 and excepting it from others and
revising the relationship between the State and City
school systems; [[changing the name of the State
Department of Education and the State Superintendent
of Schools;]] removing certain authority over
postsecondary educational programs and institutions
from the State Department of Education; creating
