Works, on behalf of the State, to acquire certain
railroad corridor property, rights or easements for
any transportation related purpose of condemnation
or otherwise; providing for notice to the Secretary
of Transportation by any railroad company of a
desire to sell or dispose of certain railroad
property; providing that the Secretary of
Transportation shall respond to such notice within a
certain period; [[and]] relieving the railroad of
any responsibility to the State under certain

conditions; and providing certain requirements for

the form of notices to the Secretary of

Transportation.

BY adding to

Article 41 — Governor — Executive and

Administrative Departments
Section 208(p)
Annotated Code of Maryland
(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Section 208(p) be and it is hereby
added to Article 41 — Governor - Executive and
Administrative Departments, of the Annotated Code of
Maryland (1971 Replacement Volume and 1975 Supplement) to
read as follows:

Article 41 — Governor — Executive and
Administrative Departments

208.

(P) (1) THE SECRETARY OF TRANSPORTATION, WITH
THE APPROVAL OF THE BOARD OF PUBLIC WORKS, ON BEHALF OF
THE STATE OF MARYLAND, MAY ACQUIRE BY AGREEMENT, GIFT,
GRANT, PURCHASE OR CONDEMNATION PROCEEDINGS AS PRESCRIBED
BY THE PROVISIONS OF TITLE 12 OF THE PEAL PROPERTY
ARTICLE OF THIS CODE FOR ANY TRANSPORTATION RELATED
PURPOSE ANY RAILROAD CORRIDOR PROPERTY, RIGHTS, OR
EASEMENTS, OR PARTS OF THEM OVER WHICH TRANSPORTATION HAS
BEEN PROVIDED AND ABANDONMENT HAS BEEN APPROVED BY THE
INTERSTATE COMMERCE COMMISSION OR OTHER GOVERNING
AGENCIES HAVING JURISDICTION.

(2)    ANY RAILROAD COMPANY DESIRING TO SELL OR
OTHERWISE DISPOSE OF ANY CORRIDOR PROPERTY, RIGHTS, OR
EASEMENTS, OR PARTS OF THEM LOCATED IN MARYLAND FOR WHICH
THE RAILROAD COMPANY HAS RECEIVED PERMISSION FROM THE
INTERSTATE COMMERCE COMMISSION OR OTHER GOVERNMENTAL
AGENCIES HAVING JURISDICTION TO ABANDON TRANSPORTATION
SERVICES, SHALL GIVE THE SECRETARY NOTICE OF ITS DESIRE
TO SELL OR OTHERWISE DISPOSE OF CORRIDOR PROPERTY,
RIGHTS, OR EASEMENTS, OR PARTS OF THEM.

(3)    THE SECRETARY, AFTER RECEIVING NOTICE
