Article 27 — Crimes and Punishments

Section 727(b)

Annotated Code of Maryland

(1971 Replacement Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 727(b) of Article 27 - Crimes and
Punishments, of the Annotated Code of Maryland (1971
Replacement Volume and 1975 Supplement) be and it is
hereby repealed and reenacted, with amendments, to read
as follows:

Article 27 — Crimes and Punishments

727.

(b) "Law—enforcement officer" means any person
who, in his official capacity, is authorized by law to
make arrests and who is a member of one of the following
law—enforcement agencies:

(1)    The Maryland State Police; or

(2)    The Baltimore City police department; or

(3)    The police department, bureau or force
of any county; or

(4)    The police department, bureau or force
of any incorporated city or town; or

(5)    The office of the sheriff of any county;

(6)    The police department, bureau or force
of any bicounty agency or the University of Maryland; or

(7)    The state Aviation Administration police
force of the Department of Transportation and the toll
facilities police force of the Maryland Transportation
Authority AND THE MARYLAND PORT ADMINISTRATION POLICE
FORCE OF THE DEPARTMENT OF TRANSPORTATION; or

(8)    The police officers of the Department of
Natural Resources.

"Law-enforcement officer" does not include an
officer serving in a probationary status except when
allegations of brutality in the execution of his duties
are made involving an officer who is in a probationary
status. The provisions of this subtitle do not apply to
persons serving at the pleasure of the police
commissioner of Baltimore City.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
