(House Bill 1517)

AN ACT concerning

Pesticide Applicator's Law — Examinations

FOR the purpose of requiring certain applicants for
certification under the Pesticide Applicator's Law
to pass a written examination; and establishing
certain requirements for persons who are private
applicators.

BY repealing and reenacting, with amendments,

Article — Agriculture

Section 5-207(c)

Annotated Code of Maryland

(1974 Volume and 1975 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 5-207 (c) of Article
Agriculture, of the Annotated Code of Maryland (1974
Volume and 1975 Supplement) be and it is hereby repealed
and reenacted, with amendments, to read as follows:

Article — Agriculture

5-207.

(c) Each applicant FOR A PEST CONTROL CONSULTANT
CERTIFICATE, PEST CONTROL APPLICATOR CERTIFICATE, OR
CUSTOM APPLICATOR CERTIFICATE shall demonstrate his
competence to use and apply pesticides safely in the
State by passing a written [or oral] examination prepared
and administered by the Department; there shall be no
charge for an initial examination, provided that pest
control applicators, pest control consultants and custom
applicators shall pay $10 for each category of
examination after the initial examination. PRIVATE
APPLICATORS SHALL PASS AN EXAMINATION OR SATISFACTORILY
COMPLETE A TRAINING PROGRAM APPROVED BY THE DEPARTMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1976.
