AND SHALL COMPLY WITH ALL APPLICABLE PROVISIONS OF §
3-801 OF THIS SUBTITLE.
(2) The Board of Airport Zoning Appeals
shall consist of [five (5) ] EIGHT members [who shall be]
appointed by the Governor, with the advice of the
Secretary of Transportation and with the advice and
consent of the Senate[, in the manner provided in § 8—801
of this article with the term of each member to commence
on or after July 1, 1974. The Board of Airport Zoning
Appeals shall be subject to and shall comply with, all of
the applicable terms and provisions contained in §
3-801].
[(3) Three] OF THE EIGHT members [of the
board], THREE shall be residents of Anne Arundel County
[and the other two members of the Board], THREE shall be
residents of [the City of Baltimore] BALTIMORE COUNTY,
AND TWO, INCLUDING THE CHAIRMAN OF THE BOARD, SHALL BE
RESIDENTS OF ANY COUNTIES, INCLUDING BALTIMORE CITY, IN
WHICH A STATE-OWNED AIRPORT IS NOT LOCATED.
(3) The chairman of the board shall be
designated by the Governor. [Vacancies on the board
shall be filled in the same manner as original members
are appointed for the unexpired term of any member whose
term becomes vacant and any member of said board shall
serve until his successor takes office.
(4) The board is authorized to appoint a
secretary of the board and such other assistants and
employees as may be necessary for the proper performance
of the duties and business of the board and all of the
appointments shall be made pursuant to the laws, rules
and regulations pertaining to or issued by the Secretary
of Transportation.]
(4) THE BOARD SHALL SIT IN PANELS AS
FOLLOWS:
(I) IF AN APPEAL TO THE BOARD CONCERNS
PROPERTY LOCATED IN ANNE ARUNDEL COUNTY, THE BOARD PANEL
SHALL CONSIST OF THE MEMBERS WHO ARE NOT FROM BALTIMORE
COUNTY; AND
(II) IF AN APPEAL TO THE BOARD CONCERNS
PROPERTY LOCATED IN BALTIMORE COUNTY, THE BOARD PANEL
SHALL CONSIST OF THE MEMBERS WHO ARE NOT FROM ANNE
ARUNDEL COUNTY.
(5) EACH MEMBER SHALL SERVE A FOUR-YEAR TERM
AND UNTIL HIS SUCCESSOR IS APPOINTED AND QUALIFIES.
HOWEVER, OF THE ORIGINAL APPOINTEES, TWO SHALL SERVE
FOUR-YEAR TERMS, TWO SHALL SERVE THREE-YEAR TERMS, TWO
SHALL SERVE TWO-YEAR TERMS, AND TWO SHALL SERVE ONE-YEAR
TERMS. A MEMBER APPOINTED TO FILL A VACANCY IN AN
UNEXPIRED TERM SHALL SERVE FOR THE REMAINDER OF THAT
TERM.
