AN ACT concerning

Aviation - Board of Airport Zoning Appeals

FOR the purpose of reconstituting the Board of Airport
Zoning Appeals; providing for the appointment of
members and specifying the terms of memberships;
specifying the duties of the Board; providing that
the Board sit in panels to hear certain appeals;
authorizing the Department of Transportation to
employ certain personnel for the Board; and
generally relating to the Board.

BY repealing and reenacting, with amendments,

Section 7-703(h)(2) and 8-802(e)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Sections 7-703(h)(2) and 8-802(e) of
Article 1A - Aviation, of the Annotated Code of Maryland
(1968 Replacement Volume and 1975 Supplement) be and they
are hereby repealed and reenacted, with amendments, to
read as follows:

Article 1A — Aviation

7-703.

(h) (2) An appeal from the denial of a permit by
the Administration may be made to the Board of Airport
Zoning Appeals[, established pursuant to § 21 of Article
62C, or its lawful successor,] by any person aggrieved by
or any office, department, board, or bureau of a
political subdivision affected by the decision of the
Administration. The board or its successor is authorized
to grant variances for State—owned airports in the manner
prescribed in subsections (d) and (e) of § 8—803.

(e) (1) There [shall be] IS a Board of Airport

Zoning Appeals which shall have and exercise with respect
to State-owned airports all the powers, duties and
functions set forth in subsection (f) of this section[.]
