(8) "Unethical conduct" means:

(i) The obtaining of any fee by fraud
or misrepresentation.

(ii) Employing directly or indirectly
any suspended or [unregistered] NONLICENSED person to
perform any work covered by this subtitle.

(iii) Using or causing or promoting the
use of any advertising matter, promotional literature,
testimonial, guarantee, warranty, label, brand, insignia,
or any other representation, however disseminated or
published, which is misleading, deceiving, improbable, or
untruthful.

(iv) Representing that the services or
advice of a person licensed to practice medicine will be
used or made available in the practice of audiology or
speech pathology if that is not true, or using the word
"doctor" or other like words, abbreviations, or symbols
if this use is not accurate.

(v) Permitting another to use his
[certificate] LICENSE.

(VI) FAILING TO ADHERE TO THE CODE OF
ETHICS ESTABLISHED BY THE BOARD.

792.

(a)    Licensure shall be granted in either speech
pathology or audiology independently. A person may be
licensed in both areas if he is qualified.

(b)    No person may practice or hold himself out as
being able to practice audiology or speech pathology in
this State [for a fee] unless he holds a current,
unsuspended, unrevoked [certificate of registration]
LICENSE issued by the Board as provided in this
subtitle[, or unless he holds a current unsuspended,
unrevoked certificate of endorsement pursuant to § 795 of
this subtitle]. The [certificate] LICENSE required by
this section shall be kept conspicuously posted in [his]
THE HOLDER'S office or place of [business] EMPLOYMENT at
all times. Nothing in this subtitle, however, shall be
construed to prevent a qualified person licensed in this
State under any other law from engaging in the profession
for which he is licensed.

(c)    The provisions of this subtitle do not apply

to:

(1) The activities, services and use of an
official title by a person in the employ of a federal
government agency, the State Department of Education or a
public school system in one of the counties or in
Baltimore City, or a state—approved nonpublic school for
