Ch. 414

CREATES A HAZARD TO A MOTORIST ON A STATE HIGHWAY.

(H) (1) THE ADMINISTRATION MAY RENEW A PERMIT ON
PAYMENT OF THE REQUIRED FEE.

(2)    AN INITIAL PERMIT MAY BE ISSUED AT ANY
TIME DURING THE YEAR AND EXPIRES ON THE FOLLOWING APRIL
30. THE ADMINISTRATION SHALL PRORATE THE INITIAL PERMIT
FEE IN ACCORDANCE WITH THE DATE OF ISSUANCE, BUT THE FEE
MAY NOT BE LESS THAN $1.

(3)    EACH RENEWAL PERMIT SHALL BE DATED MAY 1
AND EXPIRE ON APRIL 30 OF THE FOLLOWING YEAR. IF A
RENEWAL FEE IS NOT PAID BY JULY 1, THE ADMINISTRATION MAY
CHARGE A $5 LATE CHARGE. AFTER OCTOBER 1, THE
ADMINISTRATION MAY REMOVE A STRUCTURE FOR WHICH THE
RENEWAL FEE IS NOT PAID.

(I) ANY PERSON WHOSE APPLICATION FOR PERMIT IS
REJECTED BY THE ADMINISTRATION MAY APPEAL TO THE SUPREME
BENCH OF BALTIMORE CITY OR THE CIRCUIT COURT FOR ANY
OTHER COUNTY WHERE THE STRUCTURE IS TO BE LOCATED, AS THE
CASE MAY BE. THE APPEAL SHALL BE HEARD DE NOVO.

SECTION 2. AND BE IT FURTHER ENACTED BY THE GENERAL
ASSEMBLY OF MARYLAND, That new Section 204 A be and it is
hereby added to Article 56 — Licenses, of the Annotated

Code of Maryland (1972 Replacement Volume and 1975

Supplement) to read as follows:

204 A.

NOTHING IN THIS SUBTITLE SHALL CONTRAVENE THE

PROVISIONS OF ARTICLE 89B REGULATING OUTDOOR ADVERTISING
ALONG EXPRESSWAYS AND FEDERAL-AID HIGHWAYS.

SECTION[[2]]3. AND BE IT FURTHER ENACTED, That this
Act shall take effect July 1, 1976.
