any structure or advertising display which will be so
illuminated as to create a hazard to one operating a
motor vehicle upon the State highway. Any person whose
application for a permit shall be rejected by the State
Roads Commission shall have the right of appeal with
trial de novo to the circuit court of the county where
the sign is to be erected.]

(F)    WHEN THE ADMINISTRATION RECEIVES THE MATERIALS
REQUIRED UNDER THIS SECTION, THE ADMINISTRATION SHALL
ISSUE FOR THE NEXT CALENDAR YEAR EACH PERMIT FOR WHICH
THE APPLICANT APPLIED AND PAID THE FEE SET BY THE
ADMINISTRATION. THE FEE SHALL BE IN ACCORDANCE WITH THE
SIZE OF THE BILLBOARD AND STRUCTURE[[, BUT MAY NOT EXCEED
THE PRO RATA COST OF REGULATING THE LICENSING OF
ADVERTISING]] IN THE FOLLOWING AMOUNTS:

$5 FOR THE FIRST 200 SQUARE FEET OR LESS;

$8 FOR MORE THAN 200 SQUARE FEET, BUT NO BORE THAN

400 SQUARE FEET:

$10 FOR MORE THAN 400 SQUARE FEET, BUT NO MORE THAN
700 SQUARE FEET;

$17.50 FOR MORE THAN 700 SQUARE FEET, BUT NO MORE
THAN 1000 SQUARE FEET.

(G)    THE ADMINISTRATION MAY NOT ISSUE A PERMIT FOR
THE FOLLOWING STRUCTURES:

(1)    A STRUCTURE THAT EXCEEDS 1,000 SQUARE
FEET IN AREA;

(2)    A STRUCTURE THE CONSTRUCTION OR
MAINTENANCE OF WHICH WILL INJURIOUSLY AFFECT PUBLIC
TRAVEL ON A STATE HIGHWAY BY DANGEROUSLY OBSTRUCTING THE
CLEAR VIEW OF A DRIVER ON THE HIGHWAY;

(3)    A STRUCTURE LOCATED IN AN AREA OVER
WHICH THE GENERAL ASSEMBLY HAS CONFERRED ZONING POWERS IN
A BOARD OR BODY, UNLESS THE APPLICATION INCLUDES A
CERTIFICATE THAT SATISFIES THE ADMINISTRATION THAT THE
APPROPRIATE AGENCY APPROVED THE CONSTRUCTION OR
MAINTENANCE;

(4)    EXCEPT FOR DIRECTIONAL OR WARNING SIGNS
CONSTRUCTED BY OR WITH APPROVAL OF THE ADMINISTRATION, A
STRUCTURE:

(I)    LOCATED WITHIN 200 FEET OF AN
INTERSECTION OF A PUBLIC HIGHWAY WITH ANOTHER HIGHWAY,
PARKWAY, RAILROAD, OF STREET RAILWAY, AT A POINT THAT
OBSTRUCTS OR INTERFERES WITH THE VIEW OF A TRAIN,
LOCOMOTIVE, STREETCAR, OR OTHER VEHICLE APPROACHING THE
INTERSECTION OR DANGEROUS TO THE PUBLIC IN ANY WAY; OR

(II)   ILLUMINATED IN A MANNER THAT
