applicant to the State Roads Commission of a fee for the
use of the State Roads Commission in the amount of two
dollars ($2.00) for the first 100 square feet or less of
billboard or other structure on which advertising does or
may appear, and for each additional square foot of the
surface used or to be used for such purpose a sum of one
cent (1 ct.) per square foot, provided that no such
permit shall be issued by the State Roads Commission, if
the maintenance, construction or erection of such
advertisement would injuriously affect the safety of
public travel on State highways by dangerously
obstructing the clear view of the highway by one
operating a motor vehicle thereon, and provided further
that nothing herein contained shall be construed to
confer upon the State Roads Commission the power to issue
any such permits for the maintenance, construction or
erection of any such advertisement within any area over
which the General Assembly of Maryland has conferred
zoning powers in any board or body unless the application
for the permit provided for in this section shall be
accompanied by a certificate which satisfies the State
Roads Commission that the said board or body in whom such
zoning powers are vested has approved of the maintenance,
construction or erection of said advertisement as applied
for.
(e) Permits may be renewed from time to time for a
term or terms of one year each upon payment of the fee
due as provided for in this section, and may be granted
at any time during a calendar year, to expire on the
thirtieth day of April, following, upon compliance with
the terms of this section, and payment of such proportion
of 1¢ (one cent) a square foot of each billboard or other
structure or advertisement to be used as aforesaid, as
the unexpired portion of the years bears to a full year,
provided that the minimum fee shall in no case be less
than one dollar ($1.00).
The State Roads Commission in considering
applications for permits for the erection of billboards,
signs or similar structures for display advertising shall
not grant a permit for the erection or maintenance of any
billboard or other similar structure, sign, poster or
display advertising, except directional and warning signs
erected by or with the approval of the Commission, under
the following conditions:
(1) Within a distance of 200 feet of an
intersection of a public highway with another highway or
parkway or with a railroad or street railway, or at any
point where it would obstruct or interfere with the view
of a train, locomotive, streetcar or other vehicle so
approaching such intersection, or so as to obstruct the
view of any such intersection, or in any manner dangerous
to the public.
(2) The State Roads Commission is hereby authorized
and empowered to reject any application for a permit for
