Thomas Prestage    And ye Said defendt. by Michael Earle his Attry comes & defends the
ads    force & injury when &a. And for plea Saith true it is ye Said Defendt.
Walter Smith    did Seale & deliver an Obligacon unto ye Said Plaintf. for ye Sume of

   one thousand pounds of Tobo. as in ye Plaintf. Decln. is Sett forth but
Since ye Sealing and delivering Said Decln ye Said Defendt. did Severall Services and delivered
Severall Comodities to ye Said Plaintf. as by an Acct. hereunto Annexed and here in Court
brought ye Same Appeares Amounting to ye Sume of Two hundred Sixty three pounds of Tobo.
which he ye Said Defendt. prayes may be discounted out of ye Afsd debt and as to ye residue
being Seaven hundred thirty Seaven pounds of Tobo. he ye Said Defendt. doth not Gainsay &a

March ye 25. 1701          Then came Thomas Prestage & made oath that ye

   within Acct. is just & true and that he hath recd. noe

   part nor parcell thereof     Coram me Jno Hawkins

   The which Acct. being by ye Said Richard Macklin Attry of ye Said Walter Smith, produced
to ye Court & it Evidently Appearing that ye Said Acct. was due before ye Date of ye bill
Judgemt. was Awarded to ye Said Plaintf. for ye Said Sume of one Thousand pounds of Tobo.
and Cost Accrewing thereon

Therefore it is Considered by ye Court here vizt. ye 27. Day of March Anno Domi. 1701
that ye Said Plaintf. Walter Smith doe recover from ye Said Defendt. Thomas Prestage
as well ye Sume of one Thousand pounds of Tobo. Debt as alsoe ye Sume of five hundred
forty & Two pounds of Tobo. Cost of Suite and ye Said Thomas Prestage in Mercy

Command was given to ye Corroner of Kent County ye 29. Day of Novemr. Annoq Domi. 1700
                                                                            who was Exr. of Rd. Sweatnam
that he Take Elias King Exr. of ye last will & Testamt. of Edwd. Sweatnam ^ late of Talbott
County Gentn. Decd. if found in his bailiwick and him Safe Keepe Soe that he have his bodie
before his majties Justices at At ye Next Court to Answer unto John Sweatnam of A plea
of Trespass upon ye Case &a.
Which next Court vizt. ye 28. day of Janry Annoq Domi. 1700 being An Adjourned Court all
prcepts were Contd untill ye Eleventh Day of Febry following
Att which next Court vizt. ye Eleventh Day of Febry Annoq Domi. 1700 ye Day of ye
returne of Said writt According to Adjournemt. came Thomas Smith one of ye Corroners of Kent
County and made returne thereof in these words vizt.      Cepi Corpus    Thomas Smith Corr
On which Said day ye Said Defendt. by Richard Macklin his Attry Appeares and prayes
thereof to Imparle untill ye Next Court which was granted unto him ye Same day was given
[t]o ye Plaintf. likewise                      M Earle pr qr.
