And now here at this Day viz^t. y^e 27 Day of March Anno Domⁱ. 1701 y^e Said cause
Standing for Tryall came y^e S^d. Elias King Ex^r. as Afs^d. in Said Capacity by his Said Att^ry
as alsoe y^e Said Plaint^f. by Michael Earle his Att^ry and y^e Said Plaint^f. having not
filed noe Declⁿ. Judgement is awarded for A Non Suite against y^e Said Plaint^f.

Therefore it is Considered by y^e Court here viz^t y^e 27 Day of March Anno Domⁱ. 1701
That y^e Said Defend^t. Elias King Ex^r. of y^e Last will & Testam^t. of Edw^d Sweatnam
           who was ex^r. of Rich^d. Sweatnam
^ late of Talbott County Dec^d. in his Said Capacity doe recover from y^e Said Plaint^f. John
Sweatnam as well y^e Sume of fifty pounds of Tob^o. for A Non Suite as alsoe y^e Sum[e]
of one hundred fifty and four pounds of Tob^o. cost of Suite and y^e Said John Sweatnam

Comand was given to y^e Corroner of Kent County y^e Twenty Ninth Day of Novem^r. Annoq Domⁱ.
1700 That he Take Elias King high Sher^f. of Kent County if found in his bailiwick & him
Safe keepe Soe that he have his bodie before our Justices at a Court to be held for our Said
County y^e fourth Tuesday of Jan^ry Next to Answer unto Edw^d. Bathurst of y^e Kingdom
of England Merchant of A plea of Trespass upon y^e Case &^a.
Which next Court viz^t. y^e 28 Day of Jan^ry Annoq Domⁱ. 1700 being an Adjourned Court
all p^rcepts were cont^d. in y^e Sher^f. and Corroners Custody untill y^e Eleventh Day of Feb^ry
next Ensuing and y^e Said Court Adjourned untill that time

Att which next Court viz^t. y^e Eleventh day of Feb^ry Anno Domⁱ. 1700 y^e Day of
y^e returne of Said writt According to Adjournem^t. came Thomas Smith one of y^e Coroner[s]
of Kent County & made returne thereof in these words viz^t. Cepi corpus

Att which Day y^e S^d. Defend^t. Elias King by Richard
Macklin his Att^ry Appeares and prayes thereof to Imparle untill y^e next Court whi[ch]
was granted unto him y^e Same day was given y^e Plaint^f. likewise     Earle p^r q^r

And now here at this day viz^t. y^e 27. day of March Annoq Domⁱ. 1701 came as wel[l]
y^e Said Plaint^f. by his Said Att^ry as alsoe y^e Said Defend^t. by Richard Macklin
his Att^ry and y^e Said cause Standing for Tryall y^e Plaint^f. Declⁿ     viz^t.

Kent County Ss	Elias King high Sher^f. of Said County Gentⁿ. Stands Attached to Answer
in Maryland	unto Edward Bathurst of y^e Kingdom of England Merch^t. of A plea
	of Trespass upon y^e case

And whereupon y^e Said Edward by Michael Earle his Att^ry complaineth and Saith that
whereas in y^e yeare of our Lord Christ 1698 in Said County within y^e jurisdiction of this
Court A certaine Thomas Burrows late of this County Stood justly indebted by ball^e. of
Acc^t. unto y^e Afs^d. Edw^d. the Sume of Eighteen hundred forty & Two pounds of Tob^o.
as by y^e Same Acc^t. here in Court produced and unto this Declⁿ. Annexed may Appear
which Said Eighteen hundred forty and Two pounds of Tob^o. y^e Said Thomas Burrows did
not pay & Satisfie unto y^e Said Edw^d. whereby Action Accrewed to y^e Said Edw^d. to require
and have from him y^e Said Thomas Burrows y^e Afs^d. Sume of eighteen hundred forty &
Two pounds of Tob^o. And albeit y^e Said Thomas Burrowes did not pay & Satisfie unto y^e Said
Edward the Said Sume of Eighteen hundred forty & Two pounds of Tob^o. altho he was
often thereunto required Therefore for y^e more Speedy recovery and obtaining of y^e Afs^d.
Eighteen hundred forty Two pounds Afterwards that is to Say on y^e 30^th. day Novem^r.
