March Court 1701 [46] And now here at this Day vizt. ye 27 Day of March Anno Domi. 1701 ye Said cause Standing for Tryall came ye Sd. Elias King Exr. as Afsd. in Said Capacity by his Said Attry as alsoe ye Said Plaintf. by Michael Earle his Attry and ye Said Plaintf. having not filed noe Decln. Judgement is awarded for A Non Suite against ye Said Plaintf. Therefore it is Considered by ye Court here vizt ye 27 Day of March Anno Domi. 1701 That ye Said Defendt. Elias King Exr. of ye Last will & Testamt. of Edwd Sweatnam who was exr. of Richd. Sweatnam ^ late of Talbott County Decd. in his Said Capacity doe recover from ye Said Plaintf. John Sweatnam as well ye Sume of fifty pounds of Tobo. for A Non Suite as alsoe ye Sum[e] of one hundred fifty and four pounds of Tobo. cost of Suite and ye Said John Sweatnam in mercy Jno Dowdall Clk Comand was given to ye Corroner of Kent County ye Twenty Ninth Day of Novemr. Annoq Domi. 1700 That he Take Elias King high Sherf. of Kent County if found in his bailiwick & him Safe keepe Soe that he have his bodie before our Justices at a Court to be held for our Said County ye fourth Tuesday of Janry Next to Answer unto Edwd. Bathurst of ye Kingdom of England Merchant of A plea of Trespass upon ye Case &a. Which next Court vizt. ye 28 Day of Janry Annoq Domi. 1700 being an Adjourned Court all prcepts were contd. in ye Sherf. and Corroners Custody untill ye Eleventh Day of Febry next Ensuing and ye Said Court Adjourned untill that time Att which next Court vizt. ye Eleventh day of Febry Anno Domi. 1700 ye Day of ye returne of Said writt According to Adjournemt. came Thomas Smith one of ye Coroner[s] of Kent County & made returne thereof in these words vizt. Cepi corpus pr Thomas Smith Corr[nr] Att which Day ye Sd. Defendt. Elias King by Richard Macklin his Attry Appeares and prayes thereof to Imparle untill ye next Court whi[ch] was granted unto him ye Same day was given ye Plaintf. likewise Earle pr qr And now here at this day vizt. ye 27. day of March Annoq Domi. 1701 came as wel[l] ye Said Plaintf. by his Said Attry as alsoe ye Said Defendt. by Richard Macklin his Attry and ye Said cause Standing for Tryall ye Plaintf. whereas in ye yeare of our Lord Christ 1698 in Said County within ye jurisdiction of this Court A certaine Thomas Burrows late of this County Stood justly indebted by balle. of Acct. unto ye Afsd. Edwd. the Sume of Eighteen hundred forty & Two pounds of Tobo. as by ye Same Acct. here in Court produced and unto this Decln. Annexed may Appear which Said Eighteen hundred forty and Two pounds of Tobo. ye Said Thomas Burrows did not pay & Satisfie unto ye Said Edwd. whereby Action Accrewed to ye Said Edwd. to require and have from him ye Said Thomas Burrows ye Afsd. Sume of eighteen hundred forty & Two pounds of Tobo. And albeit ye Said Thomas Burrowes did not pay & Satisfie unto ye Said Edward the Said Sume of Eighteen hundred forty & Two pounds of Tobo. altho he was often thereunto required Therefore for ye more Speedy recovery and obtaining of ye Afsd. Eighteen hundred forty Two pounds Afterwards that is to Say on ye 30th. day Novemr. Annoq |
