Comand was given to ye Sherf. of Kent County ye 29. Day of Novemr. Annoq Domi. 1700
That he Take Thomas Prestige alius Dictus Thomas Prestige of Talbott County in the
Province of Maryland Planter if found in his bailiwick and him Safe keepe Soe that
he have his bodie before our Justices at A Court to be held for our Said County ye
fourth Tuesday of Janry Next to Answer unto Walter Smith of A plea of Debt
Which next Court vizt. ye 28 Day of Janry Anno Domi 1700 being an Adjourned
Court all prcepts were Contd. untill ye Eleventh Day of Febry following in ye
Sherf. Custody

Att which next Court vizt. ye Eleventh Day of Febry Annoq Domi. 1700 ye
Day of ye returne of Said writt According to Adjournemt. came Elias King high
Sherf. of Said County and made returne thereof in these words vizt. Cepi Corpus
                                                                                      pr    Elias King Sherf.
But ye Said Plaintf. Walter Smith by Rd. Macklin
his Attry moves ye Court yt. ye Sd. Defendt. Thomas Prestige may put un Espll.
baile to Said Action and Comitted into ye Sherf. Custody untill he find Espll. baile
which was granted unto him            Ordered Therefore that ye Sherf. of Kent
County doe take into his Custody ye Said Defendt. Thomas Prestige & there to remaine
untill he find Espll. baile to ye Action now depending between him & Walter Smith
who was Comitted Accordingly                                                    Jno Dowdall Clk

Att which Said Day ye Said Defendt. Thomas Prestige together wth. John Hawkins Senr. his
Security comes into Court & ye Said Majr. Jno Hawkins doth Acknowledge yt. ye Said Deft
Thomas Prestige Shall pay Condemnacon if Cast or else he will doe it for him
On which Said Day ye Said Defendt. Thomas Prestige in his proper person Appeares and
prayes thereof to Imparle untill ye Next Court which was granted unto him ye Same
day was given ye Plaintf. likewise         Macklin pr qr.

And now here at this Day vizt. ye 27 Day of March Anno Domi> 1701 came as well ye Said
Plaintf. by his Said Attry as ye Said Defendt. by Michael Earle his Attry and ye Said
cause Standing for Tryall ye Plaintf. Decln
Kent Ss       Thomas Prestige alius Dictus Thomas Prestige of Talbott County in ye Province

   of Maryland planter was Sumoned to Answer unto Walter Smith of A plea

   that he render him ye full & just Sume of one Thousand pounds of good Sound

   merchantable leafe Tobo. in Casque wch. to him he oweth & from him he unjustly

   detaineth
And whereupon ye Said Walter by Richard Macklin his Attorney Saith yt. whereas ye Said
Thomas on ye 17th. Day of Novemr. Anno Domi. 1699 by his Certaine bill or writeing
obry (at Talbott County within ye Jurisdiction of this Court) Sealed wth. his Seale as his act
& deed delivered and here in Court brought whose date is ye day & yeare Afsd. did bind him
:selfe his heires Exrs. and Adrs. to pay or cause to be well and truly paid unto ye Said Walter
Smith ye Said Sume of one Thousand pounds of Tobo. quallified as Afsd. convenient in
Chester River at or upon ye Tenth day of Novemr. next Ensui[ng y]e date of ye Same bill
yet notwithstanding ye Said Thomas ye Said Sume of one thousand pounds of Tobo. Accord
:ing to ye Tenr. of ye Same bill unto ye Said Walter he hath not paid although often demanded
but ye Same to pay he hath denyed and refused and Still doth deny and refuse & unjustly
detaine to ye damage of ye Said Walter Smith Two thousand pounds of Like Tobo. and
thereupon he brings this Suite                     Macklin pr qr.
