that ye Said Plaint Henry Carter doe recover from ye Said Defendant Elias King Exr. of Edwd. Sweatnam in his Said Capacity as well ye Sume of Seven hundred Sixty & nine pounds of Tobo. Debt as alsoe & Sume of Two hundred & eight pounds of Tobo. cost of Suite and ye Said Elias in mercy Jno Dowdall Clk

Cost of Suite and ye Said Elias in mercy Jno Dowdall Clk Wm Bateman being present by ye Grand Jury in March Court 1698 for feloniously Stealing one Colt of ye proper goods and Chattles of a Certaine Barbara Everitt and A warrant having Issued re agt. ye Said Bateman but ye Said Bateman not being app^hended ye Cause was delayed & ye Said Wm not prosecuted untill this prSent Vizt ye 28. day of Augt. Anno Domi. 1700 Att which Said 28. day of August 1700 there having A warrant Issued Comanding & requireing ye ye Sherf. of Kent County to apprhend ye body of ye Said Wm Bateman if found in his bailiwick & when Soe apprehended to Carry before Some one of his majties Justices of ye peace for Said County & with Sufficient Securities to Enter into recognizance for his Appearance at ye next Court & good behaviour in ye meanetime which next Court Vizt. ye 24. day of Sepr. being And Adjourned Court which Cause was Continued untill this prSent Court Vizt. ye 28 day of Novemr. Annoq 1700 And now here at this day Vizt. ye 28. day of Novemr. Annoq Domi. 1700 ye Said William Appeares as alsoe Richard Macklin who prosecuteth for ye King & ye Said Cause Standing for Trayall ye Said presentment was framed into an Indictmt. as followeth Vizt.
:ford Bay hundred within ye jurisdiction of this Court with force & Armes one Colt of ye price of three hundred pounds of Tobo. of ye proper goods & Chattles of a Certaine Barbara Everitt felloniously he did Steale & beare away against ye peace of our Soveraigne Lord & King and against ye forme of ye Act of Assembly in that Case made & provided Macklin pr Doms. Rege Not Guilty pr patriam pr pr And ye Said Richard Macklin who prsecutes &a. Sayes he is guilty Macklin pr Doms. Rege Comand was there[fore given] to ye Sherf. of Kent County that he cause to come here twelve &a. by whom &a. to recognize [&a. nei]ther &a. who made Answer he had there ready Twelve &a. as by his writt he was Comanded Vi[zt . Thomas] Wyatt Edward Plestoe Thomas Browne James Wyattson George Smith Nicholas Massey Da[vid David]son Thomas Hicks Edwd. Dowlin Francis Spearmint Thomas Head and Edwin Godwin which Jury being duly Sworne and having heard ye pleadings & allegacons & evindences & Court giveth them theire Charge who withdraw to Consider & prmisses and After Some time doe againe returne who being againe Called over as alsoe ye prsiner and being demanded whether ye Said Wm was Guilty as he Stood Indicted or Not doe Say the Said William is not Guilty as he Stands Indicted and by Thomas Wyatt all of them Soe Say Therefore it is Considered by ye Court here that ye Said Wm as to ye Said Indictment goe thereof without day paying his fees Jno Dowdall Clk |
