Henry Carter	Render Seven hundred & Sixty and nine pounds of Tob^o.
a^st	And y^e Said Defendant Elias King in his Said Capacity in his proper person comes
Elias King Ex^r	into Court & confesseth Judgement for y^e Said Sume & Cost of Suite
of Edw^d. Sweatnam

Therefore it is Considered by y^e Court here this day Viz^t. y^e 28. day of Novem^r. Annoq Domⁱ. 1700
that y^e Said Plaint Henry Carter doe recover from y^e Said Defendant Elias King Ex^r. of Edw^d.
Sweatnam in his Said Capacity as well y^e Sume of Seven hundred Sixty & nine pounds of Tob^o. Debt
as alsoe & Sume of Two hundred & eight pounds of Tob^o. cost of Suite and y^e Said Elias in mercy

nine pounds of Tob^o. debt as alsoe y^e Sume of Two hundred & Eight pounds of Tob^o. Cost of Suite and
y^e Said Elias in mercy Jn^o Dowdall Clk

W^m Bateman being present by y^e Grand Jury in March Court 1698 for feloniously Stealing
one Colt of y^e proper goods and Chattles of a Certaine Barbara Everitt and A warrant having Issued
re
ag^t. y^e Said Bateman but y^e Said Bateman not being app^hended y^e Cause was delayed &
y^e Said W^m not prosecuted untill this p^rSent Viz^t y^e 28. day of Aug^t. Anno Domⁱ. 1700
Att which Said 28. day of August 1700 there having A warrant Issued Comanding & requireing y^e
y^e Sher^f. of Kent County to app^rhend y^e body of y^e Said W^m Bateman if found in his bailiwick &
when Soe apprehended to Carry before Some one of his maj^ties Justices of y^e peace for Said County
& with Sufficient Securities to Enter into recognizance for his Appearance at y^e next Court & good
behaviour in y^e meanetime which next Court Viz^t. y^e 24. day of Sep^r. being And Adjourned Court
which Cause was Continued untill this p^rSent Court Viz^t. y^e 28 day of Novem^r. Annoq 1700
And now here at this day Viz^t. y^e 28. day of Novem^r. Annoq Domⁱ. 1700 y^e Said William Appeares
as alsoe Richard Macklin who prosecuteth for y^e King & y^e Said Cause Standing for Trayall y^e Said
presentment was framed into an Indictm^t. as followeth Viz^t.

Kent Ss	The Jurors for our Soveraigne Lord y^e King that now is for Kent County upon theire Oathes doe
	p^rSent William Bateman alius dictus William Bateman of y^e Said County planter for that

he y^e Said William Bateman y^e Tenth day of October Anno Domⁱ. 1698 in y^e Said County in Upper Lang:
:ford Bay hundred within y^e jurisdiction of this Court with force & Armes one Colt of y^e price of
three hundred pounds of Tob^o. of y^e proper goods & Chattles of a Certaine Barbara Everitt felloniously he
did Steale & beare away against y^e peace of our Soveraigne Lord & King and against y^e forme of y^e Act of
Assembly in that Case made & provided                      Macklin p^r Dom^s. Rege
Not Guilty p^r patriam p^r p^r       And y^e Said Richard Macklin who p^rsecutes &^a. Sayes he is guilty
                                                                                 Macklin p^r Dom^s. Rege
Comand was there[fore given] to y^e Sher^f. of Kent County that he cause to come here twelve &^a. by whom
&^a. to recognize [&^a. nei]ther &^a. who made Answer he had there ready Twelve &^a. as by his writt he
was Comanded Vi[z^t . Thomas] Wyatt Edward Plestoe Thomas Browne James Wyattson George Smith
Nicholas Massey Da[vid David]son Thomas Hicks Edw^d. Dowlin Francis Spearmint Thomas Head and Edwin
Godwin which Jury being duly Sworne and having heard y^e pleadings & allegacons & evindences & Court giveth them
theire Charge who withdraw to Consider & p^rmisses and After Some time doe againe returne who being againe
Called over as alsoe y^e p^rsiner and being demanded whether y^e Said W^m was Guilty as he Stood Indicted or Not doe
Say the Said William is not Guilty as he Stands Indicted and by Thomas Wyatt all of them Soe Say
Therefore it is Considered by y^e Court here that y^e Said W^m as to y^e Said Indictment goe thereof without day
paying his fees
