63 said Benjamin Philip John and Leonard and to and with each of them their and each of their Heirs and Assigns that he the said Charles Carroll and his heirs shall and will at all times hereafter at the reasonable request and Charge of them the said Benjamin Philip John and Leonard their heirs and Assigns make do execute and acknowledge any further Act or Acts thing or things Deed or Deeds of Conveyance in the Law which the said Charles Carroll or his heirs may lawfully do to transfer convey and absolutely vest in the said Benjamin Philip John and Leonard their heirs and Assigns for ever all right title interest and Estate either in Law or Equity of the said Charles Carroll and the heirs of his Uncle Daniel Carroll deceased in and to the premises aforesaid And it is the true intent and meaning of this Indenture and so declared by the parties hereto that the said Charles Carroll conveys and makes over to the said Benjamin Philip John and Leonard their heirs and Assigns all right title Interest and Estate either in Law or Equity which he the said Charles Carroll and the heirs of Daniel Carroll afores.d or either of them have in the premises aforesaid without interfering with or in any manner impeaching or meaning to impeach or effect any Right Title or Interest which any person or persons have in the said Land called Coles Harbour and Todds Range under purchase heretofore made from Charles Carroll deceased or Daniel Carroll aforesaid or any person under whom the aforesaid Charles Carroll of Carlton claims or derives his title to the said Land nor does the said Charles Carroll of Carlton mean intend or bind himself or his heirs to do any Act or thing in the premisses except such as shall be necessary and proper in Law to vest in and secure to the said Benjamin Philip John and Leonard their heirs and Assigns the right and Title in the premises which now remains in the said Charles Carroll of Carlton and the heirs of Daniel Carroll aforesaid or either of them after Justly and fairly gratifying all Sales heretofore made by the persons under whom the said Charles Carroll of Carlton and the heirs of the said Daniel or either of them derived their Title And further he the said Charles Carroll for himself and his heirs Covenants to and with the said Benjamin Philip John and Leonard and each of them their and each of their heirs and Assigns that he the said Charles Carroll of Carlton and his heirs will for ever warrant and defend the said Tract piece or parcel of Land against the heirs of the aforesaid Daniel Carroll deceas'd and against all and every person or persons claiming by from or under him them or any of them according to the true intent and meaning hereof as above declared In witness whereof the said parties have hereunto interchangeably set their hands & Seals the day and year first above written Signed Sealed and delivered Ch Carroll of Carrollton (Seal) in presence of Henry Wilson Geo Welch On the back of the aforegoing Instrument of writing was thus written Viz.t Receiv'd the day and year first within written of and from the within mentioned Benjamin Philip John and Leonard the Sum of Eight hundred and fifty pounds Current Money of Maryland it being the Consideration herein mentioned to be paid by them Witness Henry Wilson Ch Carroll of Carrollton |
