417 same the yearly Rent or sum of seven shillings and six pence in manner and form as the same is above reserved to be paid And if it shall so happen that the said Yearly Rent or sum of Seven shillings and six pence Current Money of the said State afs.d shall be in arrear and unpaid by the Space of Fifty days next after the Term on which the same is above reserved to be paid that then it shall and may be lawful for the said Andrew David Joseph and Benjamin Ellicott their Heirs or Assigns into the said Demised premisses to enter and make distress in and upon any part thereof for the same And further that they the said Andrew David Joseph and Benjamin Ellicott their Heirs and assigns shall and will upon the request and at the proper cost and charge of him the said Joseph Evans his Heirs or assigns upon his or their paying or Tendering the payment of the sum of Seven shillings and six pence Curr.cy in the name and as a fine for Renewm.t at any time during the continuance of this present demise make and Execute to him the said Joseph Evans his Heirs or assigns so requesting paying or Tendering the payment as aforesaid a new Lease of the said Demised premises for NInety Nine Years to take Effect and commence at the end of the time for which the same is hereby Demis'd under the same Rent with the same clauses covenants and agreements as are herein contained so that this present demise may be renewable and renewed for ever And that they said Andrew David Joseph and Benjamin Ellicott their Heirs Exr.s Adm.rs or assigns the aforesaid Demis'd Ground and premisses with their and every of their appurtenances for and during the aforesaid Term of Ninety Nine Years hereby Letten shall and may peaceably and Quietly Have hold use occupy possess and enjoy for and on the payment of the Rents and Performances of the Covenants and conditions herein before mentioned on the part and behalf of the said Joseph Evans his heirs Exr.s Administrators and assigns to be paid and performed according to the true intent and meaning of these presents from and against them the said And.w David Joseph and Benjamin Ellicott and against every other person or persons claiming or to claim any thing therein by from or under them their Heirs Exr.s Adm.rs or assigns or any of them and upon any such Default as aforesaid according to the true intent and meaning hereof these presents and every other clause Matter and thing therein contained as from and against the said Andrew David Joseph and Benjamin Ellicott shall become Absolutely Null and Void to all Intents and purposes whatsoever In Witness whereof the said parties to these presents have hereunto Interchangeably set their hands and seals the day and Year first above written Signed Sealed and And.w Ellicott (seal) Delivered in the presence of Lewis Evans David Ellicott (seal) William Evans NB the rasure of the word Joseph Ellicott (seal) Joseph was made before the sealing and delivery Benj.a Ellicott (seal) of these presents Joseph Evans (seal) On the back of the aforegoing Deed was thus endorsed (Viz) (Balt) |
