349 of such Survivor or a Majority of them shall and do first Well and truly Pay the Rents of the House and Stores hired of William Smith now occupied by the said Clement Biddle and Company and of the House hired by the said Clement Biddle of the Trustees of the University of the State of Pennsylvania which hath been heretofore and now is occupied by the said Clement Biddle and Company and Rodolp Tellier now due and in arrear and which may become due until the Trustees herein named shall see fit that they be surrendered up And also All such Taxes and Assessments which have been Levied when the same Premisses and which Remain unpaid and also well and truly Pay unto the said Major General Peter Mulenberg the sum of Seventy four Pounds shillings and Pence due and payable to him for Defraying the Expences upon the Virginia Military Land Warrants aforesaid And also shall and do well and truly Pay and Discharge all and every the Morgages Legacies and other Incumbrances to which the Premisses hereby Granted and Assigns heretofore were and now are Liable and subject and shall pay and distribute the remainder (after all Expences and Charges attending the Trust are first Deducted) towards the payment and Discharge of all the Just Debts Dues and Demands which are due to Themselves and all and every the other Creditors of the said Clement Biddle and John Biddle and John Biddle and Clement Biddle and Company and Clement Biddle and Company and Rodolph Tellier and which have been before the day of the Date of these Presents bona fide and without Fraud contracted by them or Either of them in such shares and Proportions as each respective Debt or Demands shall bear to the sum so to be raised and Distributed as afo^r^esaid And upon this further trust and Confidence that if all or any of the Creditors of the said Clement Biddle and John Biddle or Clement Biddle and Company or Clement Biddle and Company and Rodolph Tellier shall refuse or Neglect to accept of their proper Proportion or Dividend of the money to be Raised in virtue of this present Bargain Sale and Assignment or to give the said Clement Biddle and John Biddle an Acquittance and release under Hand and Seal thereby Discharging them and (Each) |
