177 and payable and shall be lawfully demanded And the said John Darnall for himself his Heirs Executors Administrators doth hereby covenat grant and agree to and with the said William Ritchie his Heirs and Assigns in manner following that is to say that he the said John Darnall and his heirs the said lott A portion of Ground agreeable to the description and bounds thereof herein before expressed together with all and singular the Premises and every of its rights members and Appertenances of from and against as well him the John Darnall and his Heirs and all persons Claiming or that shall or may hereafter Claim by from or under him them or any of them as also of from and against all and every person or Persons Claiming or that shall or may hereafter claim the same from by or Under the said John Darnall deceased father to the said John Darnall party hereto shall and will well and sufficiently Warrent and for ever defend to the said William Ritchie his Heirs and Assigns And that he the said John Darnall and his heirs shall and Will at any time hereafter at the reasonable request and proper Costs and charges of the said William Ritchie his Heirs and Assigns make do execute and duly Acknowlede all and every such further or other Act or Acts Deed or deeds Conveyances or other Assurances in the law Whatsoever for the better and more Perfect granting conveying and Assuring the same Lott or Portion of Ground and Premises with its appertenances to the aforesaid William Ritchie his Heirs and Assigns for ever as by him or them or by his or their Council learned in the law shall be reasonable advised devised or required Provided that such further or other conveyances or Assurances do not contain any other or greater Covenant of Warrenty then is herein before mentioned and expressed And further the same John Darnall hereby covenats engages and declares that the Same lott or portion of Ground and Premises is clear and free of all incumbrances and Charges of every kind at this time except the yearly rent above mentioned which is twelve shillings Current Money payable annually from the said tenth day of May seventeen hundred and seventy Nine In Witness Whereof the Parties have hereunto interchainable sett there hands and Affixed there seals the day and year first in this Present indenture Written Signed sealed and delivered John Darnall (Seal) in the Presents of Us Henry Darnall George Scott Received on the 28.th Day of August 1783 of and from the within and aforenamed William Ritchie the Just and full Sum of four Hundred and twenty five Pounds Current Money of Maryland in Specie at the rates paid by law being the Consideration within Mentioned to be by him paid to me for the lott Hereditaments and Appertenances conveyed to him by the within deed Witness Henry Darnall John Darnall George Scott Frederick County to wit On the 28.th Day of August 1783 came before us the subscribers two of the Justices of the Peace in and for Frederick County the within named John Darnall and Acknowledged the within Instrument of writing to be his act and Deed and the Lott Hereditaments and Appurtenances therein mentioned and intended to be Conveyed to be the right Title and Estate of the within mentioned William Ritchie his Heirs and Assigns for ever According to the true intent and meaning of the same Deed and of the acts of Assembly in such Case made and Provided County Before Henry Darnall Seal George Scott Recorded November 26 1783 |
