171 Ex.d & dl.d Know all Men by these Presents that I William Fell of Fells Point in the County of Boltimore and State of Maryland Intending upon a Voyage to Europe and being desirous to leave some Gentlemen in America to be my Agent and to settle my affairs during my absence have made ordained constituted and appointed and by these presents do make ordain constitute and appoint David McMacken of Boltimore Town aforesaid Attorney at Law my true and lawful Attorney for me in my Name place Stead and for my use to ask demand sue for and receive all Accounts Debts dues and demands due or hereafter to become due and owing to me in Boltimore County aforesaid or in any of the united States of America and to give full discharges Receipt releases and acquitances for the same and likwise to ask demand Sue for distress and receive all rents and Arrearages of rents due or hereafter to become due and owing to me in Boltimore County aforesaid or any of the Said States from any Person or Persons Whatsoever; and in case of nonpayment of said rent to make destress and sale for the Same or to reenter forfeit reocupy and Possess the Same in fee in my Name for my use as my Estate according to the tenor of Said leases And further I do make ordain Constitute and impower my Said Attorney for me in my Name and for my use to again lease sett and to farm lett any of the Said forfeited Lotts or any other of my Said lands or tenements in Boltimor County aforesaid or the States aforesaid for Ninty nine Years with Covenants and Conditions of renewment from time to time for ever or for any lesser number of Years for Such Premiums and such Ground rent to be paid half yearly or yearly and with such Other Conditions and Provisions as my said Attorney shall think will most conduce to my Interest and whereas many disputes have Arrisen and may hereafter Arrise between sundry Persons and myself Concerning the locations boundaries contracts agreements and titles of Sundry tracts of land in the said County of Boltimore or in the States aforesaid and being desirous of defending my right or Prosecuting my title in order to ^have^ them settled; I do authorize constitute appoint and require my said Attorney to commence any Action or Actions suit or suits or defend any Action or Actions Suit or Suits in any Court of law or Equity for the recovery or defending the same or to settle and finally determine the same by the rule of reference or Arbitration as he shall think will most conduce to my Emolument and Advantage and I do further constitute Authorize appoint and impower my said Attorney fro me in my Name and for my Use to sell and Convey in fee simple any Such lands and tenements that I have in Boltimore County Aforesaid or the States aforesaid for such Price or Sums of Money as the same shall be worth and to sighn seal deliver and Acknowledge Such deeds and Conveyances for the same in Order to have them recorded |
