163 the Business now in his Hands shall Accrue and become Due to me on my Account whatsoever and particularly of and from all and every of the persons who are now indebted to me by Bond or list of whose Names with the principal sums are hereunto Annexed; And to have Use and take all Lawfull ways and Means for the Recovery thereof by Attachment Arrest Distress or otherwise And to Compound and Agree for the same; And Acquittances or Other Sufficient Discharges for the Same for me and in my Name to make Seal and Deliver; And the Money aforesaid when Recovered for Sums due or hereafter to become Due to Apply and Appropriate in the first Instance to the Discharge of the Debts which are now due from me a List of which are also hereunto Annexed; And afterwards towards discharging such other Debt or Debts as I shall by Letter or Letters advise and direct him to pay and discharge; and also towards purchaseing such Real or personal property as he shall from time to time be by me requested to purchas And to do all other Lawfull Acts and things whatsoever Concerning the premisses as fully in every respect whatsoever as I myself might or could do where I personally present at the doing thereof; And Attornies one or more under him for the purposes aforesaid to make And again at his pleasure to revoke; hereby ratifying and Confirming, and by these presents Allowing whatsoever my said Attorney shall shall in my Name lawfully or Rightfully do or Cause to be done in and about the premisses in and by Virtue of these presents In Witness whereof I have hereunto Set my Hand and Affixed my Seal this Eighteenth day of September in the Year of Our Lord One thousand Seven hundred and Eighty three Tho.s Rutland (Seal) Sealed & delivered In presence of W Hanson McPherson Anne Arundel County fs On the 22.d day of September 1783 Came the above named Thomas Rutland before the Subscribers two of the Justices of the County aforesaid & Acknowledged this Instrument of Writing to be his Act and Deed W.m Hyde Recorded 8.th October 1783 Francis Fairbrother Ex.d & dl.d & p.d Ann Arundel County State of Maryland fs This Indenture made this 14.th day of October One thousand Seven hundred and Eighty three Between Thomas Whittington Senior and Thomas Smith of the State and County above mentioned Witnesseth That I Thomas Smith of the State and County aforesaid for and in Consideration of the Quantity of Seventeen thousand Eight hundred and Seventeen pounds of Neet Crop Tobacco in hand paid at and before the ensealing and delivery of these presents by Thomas Whittington Senior of the County and State above mentioned The receipt whereof I do hereby Acknowledge have Bargained and Sold and by these presents Do Bargain and Sell Unto the same Thomas Whittington Senior two Tracts or Parcels of Land Called Halls Hills & Mukins.s Hills said to Contain fourty Acres of Land lying the Quarter Part in Calvert County and the Remainder in Ann Arundel County also two Negro Women by Name Priss and Jene with their future Increase Unto the said Thomas Whittington Senior his Heirs Executors Administrators and Assigns the Only Proper Use and behoof of him the said Thomas Whittington Senior his Heirs Executors Administrators and Assigns forever And I the said Thomas Smith for myself my Heirs Executors and Administrators the aforesaid Land and Negroes shall and will warrant and forever defend |
