164 Defend against all persons by these presents provided Nevertheless And it is hereby agreed between the parties that if the said Thomas Smith his Heirs Executors and Administrators do and shall well and truly pay Unto the said Thomas Whittington Senior his Heirs or Assigns the full and Just Quantity of Seventeen thousand Eight hundred and Seventeen pounds of Neet Tobacco with Legan Interest thereon then this present Instrument of Writing to be Null and Void and of no Effect But in failure in such then the said Thomas Wittington Senior His Heirs or Assigns to take the aforesaid Lands & Negroes with their Increase together with all the Buildings and Appurtenances belonging to said Land And Expose them to Sale to the highest Bidder and if the said Land and Negroes sell for more Tobacco then the aforesaid Seventeen thousand Eight hundred and Seventeen pounds of Neet Crop Tobacco and Interest thereon with Charges the Overpluss to go to the Credit of the said Thomas Smith and be fairly Accounted for by the said Thomas Whittington Senior his Heirs or Assigns But in Case the aforesaid Land and Negroes should not sell for so much as the aforesaid Seventeen thousand Eighteen hundred and Seventeen Pounds of Neet Crop Tobacco and Interest and Charges then I the said Thomas Smith do hereby bind myself my Heirs Executors and Administrators in the full and Just Quantity of Seventeen thousand Eight hundred and Seventeen pounds of Neet Tobacco with Interest thereon In Witness Whereof I have hereunto Set my hand and Seal this day and Year above mentioned Signed Sealed and Delivered the word Whittington in the Thomas Smith (Seal) in the presence off Ninth line being first Rich.d Harwood sen.r Interlined William Faris State of Maryland 14 October 1783 Came Thomas Smith above mentioned and Acknowledged the above Instrument before the Subscriber One of the Judges of the General Court for the State above mentioned And Acknowledged the above Instrument of Writing to be his Act and Deed And the Land and Negroes above mentioned to be the Proper Use and Estate of the above mentioned Thomas Wittington Senior his Heirs and Assigns forever According to the true Intent and meaning thereof and the Act of Assembly in Such Cases made and provided Rob H Harrison Recorded 14.th October 1783 This Indenture made this twenty Seventh day of July in the Year of Our Lord One thousand Seven hundred and Eighty three Between Thomas Bond of Harford County And Catharine his wife of the one part And William Fell of Fells Point in Baltimore County Esquire of the other part Witnesseth That the said Thomas Bond and Catharine his wife for and in Consideration of fifteen hundred pounds current Money to them in hand paid by the said William Fell before the ensealing and delivery of these presents the receipt whereof is hereby Acknowledged And for other good Causes and Considerations them the said Thomas Bond and Catharine his wife specially Moving have Bargained and Sold And by these presents do Bargain and Sell Unto the said William Fell his Heirs Executors Administrators and Assigns all these following Plantations Farms and Tracts of Land situate in the State of Maryland that is to say the Tract of Land called Fells Dale near Westminster in Baltimore and Fredrick Countys The Tract of Land called Coombs Adventure near the Ferry Branch in Baltimore County the Tract of Land called Swathmore in Harford County And all and Singular the Lands |
