97 or Tracts of Land herein after described to and for the Uses and Purposes following (that is to say) to and for the use of the aforesaid Richard lee for and during the Term of his natural Life and after his decease as to such part thereof as is herein after for such purpose described to and for the use of Grace the wife of the said Richard Lee for and during her Natural Life and as to such other part thereof not Limitted to Grace the wife of the said Richard Lee after his Decease to and for the use of Philip Thomas Lee and Ann his wife in respect of one equal third part of such part not Limitted to Grace the wife of the said Richard Lee during their Natural Lives and of the Heirs and Assigns of the said Philip Thomas Lee and in respect of the other two third of the said Tract not Limitted to the said Grace wife of the said Richard Lee to and for the use of the aforesaid Philip Thomas Lee his Heirs and Assigns for ever and as to such part Limitted to and for the use of the said Grace wife of the aforesaid Richard Lee for her Life after the deceas of the said Richard Lee to and for the use of the said Philip Thomas Lee and Ann his wife during their Natural Lives and of the Heirs and Assigns of the said Philip Thomas Lee after the decease of the said Richard Lee and Grace his wife as to one equal third part of the part aforesaid so Limitted as aforesaid to the said Grace wife of the said Richard Lee and as to the other two third parts of the part so Limitted to the said Grace wife of the said Richard Lee to and for the use of the aforesaid Philip Thomas Lee his Heirs and Assigns after the decease of the said Richard Lee and Grace his wife it being the Intent and desire of the parties that a provision should be made for the aforesaid Ann the wife of the said Philip Thomas Lee upon the Events aforesaid in the Nature of Dower And Whereas it is expected that the aforesaid James Russell will pay or secure to be paid a Sum of Money to the aforesaid Philip Thomas Lee equal to the value of the Estate and Interest hereby intended to be conveyed to and vested in the said Philip Thomas Lee and for that purpose it hath been agreed that an appraisment or valuation of the said Estate and Interest should be made by Charles Grahame and Philip Richard Fendall Gentlemen or the survivor of them and in Case the said James Russell should refuse or omit to pay or cause to be paid such Sum of Money it hath been agreed that this Indenture and every part thereof should be void and the whole and intire Estate in all the Lands herein mentioned be revested in the said Richard Lee in as full and ample manner as if this Indenture had not been made Now (this) |
