731 Assurances in the Law whatsoever for the further and more perfect granting conveying and assuring the said fifth Part of the Peices or Parcels of Land herein before described with their Appurtenances and every Part and Parcel thereof unto him the said Michael Arthur his heirs and Assigns as by the said Michael Arthur his heirs or Assigns or his or their Counsel learned in the Law shall be reasonably devised or advised and required so as such Deed or Deeds Conveyance or Conveyances Assurance or Assurances contain no other or further Warranty or Covenants than are herein contained And further that he the said Richard Potts and his heirs the said Lands and Premisses hereby granted and sold with their Appurtenances and every Part and Parcel thereof unto him the said Michael Arthur his Heirs and Assigns against him the said Richard Potts and his heirs and against all Persons claiming by from or under him them or any of them shall and will warrant and for ever defend by these Presents In Witness whereof the said Richard Potts hath hereunto set his hand and Seal the Day and Year above written Richard Potts (LS) Signed sealed and delivered (the word doth being first inserted between the twentieth and twenty first Lines) in the Presence of Philip Thomas Lee Geo Ranken On the Back of the foregoing Deed was thus indorsed to wit Received on the Day and Year within written of and from the within named Michael Arthur the Sum of ninety five Pounds Barbados Currency being the Consideration within mentioned to be by him paid to me Richard Potts Witness Philip Thomas Lee On the twenty seventh Day of September seventeen hundred and seventy four came before me the Subscriber one of his Lordship's Justices of the Provincial Court of the Province of Maryland the within named Richard Potts and acknowledged the within Instrument of Writing to be his Act and Deed and the Lands and Premises therein mentioned with the Appurtenances to be the Right and Estate of the within named Michael Arthur his heirs and Assigns forever Philip Thomas Lee Maryland to wit The Honorable Richard Lee Esquire President and Commander in Chief in and over the Province aforesaid To all to whom these Presents shall come Greeting I do hereby certify that Philip Thomas Lee Gent.n before whom the above Acknowledgment of the within Deed was made is one of the Right Honorable the Lord Proprietary's Provincial Judges for the Province aforesaid and that full faith and Credit is and ought to be given to all Things by him so certified In Testimony whereof I have hereunto set my hand and caused the Seal of Province to be affixed at Annapolis this twenty seventh Day of September in the Year of our Lord seventeen hundred and seventy four Rich.d Lee Recorded 27.th September 1774 (LS) (Charged thus far) |
