726) On the back of the aforegoing Deed was thus Endorsed Viz.t On the nineteenth Day of September seventeen and seventy four Came before me one of his Lordships Justices of the Provincial Court the within named Daniel Dulany and acknowledged the within Instrument of Writing to be his Act and Deed and the Lands and premises therein contained to be the Right and Estate of the within mention'd Osgood Hanbury and Company their Heirs and Assigns according to the true Intent and Meaning thereof 5 Sides Philip Thomas Lee Mem To which aforegoing Mortgage was annexed the following Acquiescence to wit Know all Men by these Presents that I do hereby bind Myself to acquiesce in and abide by such Landed Security as Daniel Dulany shall make or cause to be made to Mess.s Hanbury's or their or either of their Assigns and do hereby renounce my title to so much as shall be so given in Security as aforesaid for the Claims of Messrs Hanbury or their or either of their Assigns Provided that a full Third of the Lands be reserved clear of Incumbrances to answer my Right of Dower Annapolis June 22.d 1774 Mary Dulany (LS) Witness Daniel Dulany Recorded Sept.r 20.th 1774 Ex.d This Indenture made this Eighteenth day of May in the year of our Lord One Thousand Seven hundred and seventy four Between Nathan Waters of Ann Arundel County Gentleman of the one part and Elizabeth Mc Clelan of the City of Annapolis of the other part Witnesseth that the said Nathaniel Waters for and in Consideration of the Sum of One Hundred and Seventy four pounds Sterling Money to him the said Nathan Waters by the said Elizabeth McClelan in hand paid at or before the Sealing and delivery of these presents the receipt and payment whereof the said Nathan Waters doth acknowledge and therof thereof and therefrom and of and from every part and parcel thereof doth acquit release exonerate and discharge the said Elizabeth McClelan her Heirs Executors and Administrators and Every of them and by these presents hath Granted Bargained Sold Aliened released Enfeoffed and Confirmed and by these doth Grant Bargain Sell Allien release ^Enfeoff^ and Confirm unto the said Elizabeth her Heirs and Assigns all that Part or Parcel of a Lot of Ground (Number Seventy three) Situate in the City of Annapolis between St Anns Church and the Publick Cuite now in the Tenor and Occupation of Denis Dulany Esquire begining at a post fixed in the Line of School Street and running thence with the said Street a West Course thirty five and a half feet thence a South Course thirty one and a half feet thence East thirty five and a half feet thence with a streight Line to the Begining together with all and Singular the Houses Edifices Buildings Gardens Ways Waters Easements Priviledges Commodities and advantages to the Same begining belonging or in any wise appertaining and the reversion and |
