687 Daniel Charles Heath and his Heirs and Assigns one ^equal^ undivided Moiety or half part of the several Tracts of Land after mentioned that is to say One Tract of Land lying in Cecil County called Holt containing seven hundred Acres more or less One other Tract of Land lying partly in Cecil and partly in Kent County containing four hundred and fifty Acres more or less called Toes Purchase the second and third part of Heaths Range lying in Kent County containing nineteen hundred and eighty six Acres more or less and one Tract of Land lying in Kent County called the Forest containing two hundred Acres more or less All which Lands were devised by the said James Heath to Benjamin Dulany son of Daniel Dulany Esquire of the City of Annapolis afd and to the said Daniel Dulany party to these presents to be equally divided between them and their Heirs forever Together with all Houses Buildings Gardens Orchards Fences Trees woods underwoods Profits Commodities Hereditaments and Advantages to the same Lands and every part thereof belonging or appertaining and also the Reversion and Reversions Remainder and Remainders Rents and Services of the said bargained premisses and every part and parcel thereof and all the Estate Right Title Interest property Claim and Demand both in Law and Equity of him the said Daniel Dulany party to these presents of in and unto the said premisses and every part and parcel thereof with the Appurtenances To Have and To Hold the same bargained premisses and every part and parcel thereof with the Appurtenances unto the said Daniel Charles Heath and his Heirs and Assigns to the only proper Use and Behoof of the said Daniel Charles Heath and his Heirs and Assigns for ever In Witness whereof the said parties ^have^ to these presents set their Hands and Seals interchangeably the Day and year above written Dan.l Dulany j.r (LS) Sealed and Delivered In the presence of Philip Thomas Lee Dan.l Cha.s Heath (LS) Be it remembered that on the twenty seventh Day of May One thousand seven hundred and seventy four Before me the Subscriber one of the Lord Proprietary of Maryland his Justices of the Provincial Court personally appeared Daniel Dulany of the City of Annapolis Esquire the Bargainor in this Indenture named and acknowledged the same Indenture to be his Act and Deed and the Lands and premisses thereby bargained and sold to be the Right and Estate of the within named Daniel Charles Heath the Bargainee and his Heirs and Assigns for ever Thus taken and acknowledged the Day & Year afd before me Philip Thomas Lee 7½ Sides Rec.d of M.r Dan Cha.s Heath the Sum of three Pounds six shillings and nine pence Sterling being the Alienation fine due for one half part of the within Land to the Lord Proprietor by Virtue of a Commission from Dan of S.t Tho.s Jenifer Esq.r his said Lordships Agent and Receiver General John Brice Recorded the 6.th Day of June 1774 Ex.d This Indenture made the Twelfth Day of March 1774 Between John Lee of Virginia Brother and Heir at Law of Corbin Lee late of Baltimore County Gentleman deceased of the one part and Charles Graham of Calvert County and Anthony Stewart of the City of |
