678 above by these Presents bargained and sold with all and every the Appurtenances unto them the said Joseph Hayward and Jacob Hayward their Heirs and Assigns as Tenants in Common and not as Joint Tenants from and against him the said Roger Randall and his Heirs and against all Persons claiming or to claim the same or any Part thereof by from from or under him the said Roger Randall or his Heirs shall and will warrant and for ever defend by these Presents In Witness whereof the said Roger Randall hath hereunto set his Hand & affixed his Seal the Day and Year first above written Sealed & Delivered In the Presence of Rog.r Randall (LS) W.m Spencer Freeman Newman On the Back of the aforegoing Deed was thus indorsed (Viz.t) Reced the 11.th Day of December 1773 of Joseph Hayward & Jacob Hayward the Sum of fifty four Pounds Current Money being the full Consideration Money within mentioned £54 Rog.r Randall Witness Psent W.m Spencer Baltimore County fs.t On the 11.th Day of December 1773 before us the Subscribers two of the Justices of the Peace for said County came Roger Randall and acknowledged the within Indenture of Bargain and Sale to be his Act and Deed according to the true Intent and Meaning thereof and Lands and Premisses within mentioned to be bargained and sold to be the Right Title Interest and Property of the within named Joseph Hayward & Jacob Hayward as Tenants in Common & not as Joint Tenants their several and respective Heirs and Assigns forever Acknowledged before John Moale Tho.s Sollery Baltimore County fs.t On the twenty third Day of April 1774 before us the Subscribers two of the Justices of the Peace for said County came Rachel the Wife of the within named Roger Randall & being by us privately examined apart from her said Husband did acknowledge all her Right of Dower to the within bargained Premisses to be the Right Title Interest Estate and Property of the within named Joseph Hayward & Jacob Hayward their Heirs & Assigns for ever and at the same Time did declare that she made such Acknowledment of her own free and voluntary Will and Accord without being thereto induced by any Fears Threats or ill Usage of her said Husband or through Fear of his Displeasure Taken & Acknowledged Before W.m Spear Jon.a Plowman 8½ Sides Received of M.r Joseph and Jacob Hayward the Sum of nine Pence Sterling being the Alienation Fine due on the within Land to the Lord Proprietary by Virtue of a Commission from Dan of S.t Tho.s Jenifer Esq.r his said Lordships Agent & Receiver Generall J Brice Recorded 11.th May 1774 |
