677 Ex.d Maryland fs.t This Indenture made the eleventh Day of December One thousand seven hundred and seventy three Between Roger Randall of the County of Baltimore in the Province aforesaid of the one Part and Joseph Hayward and Jacob Hayward both of the same County and Province of the other Part Witnesseth That the said Roger Randall for and in Consideration of the Sum of fifty four Pounds Current Money to him in Hand well and truly paid by the said Joseph Hayward and Jacob Hayward at and before the Ensealing and Delivery of these Presents The Receipt whereof he doth hereby acknowledge and himself therewith fully satisfied contented and paid hath granted bargained sold aliened released enfeoffed and confirmed and by these Presents Doth grant bargain sell alien release enfeoff and confirm unto them the said Joseph Hayward and Jacob Hayward as Tenants in Common and not as Joint Tenants and to their Heirs and Assigns for ever All that Part or Parcel of a Tract of Land situate in the Counties of Baltimore and Ann Arundel and known and distinguished by the Name of Stout which hath not been heretofore by the said Roger Randall sold and conveyed to any Person or Persons whatsoever Containing by Estimation eighteen Acres more or less Together with all and singular the Rights Liberties Priviledges Hereditaments and Appurtenances whatsoever to the Rest Residue and Remainder of the said Tract of Land Stout and heretofore sold and conveyed as aforesaid belonging or in any Wise appertaining And the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof And also all the Estate Right Title Interest Use and Possession Trust Property Claim and Demand whatsoever of him the said Roger Randall or his Heirs of into or out of the same or of in to or out of any Part or Parcel thereof To have and to hold the one equal and Undivided half Part of all the said Rest Residue and Remainder of the said Tract of Land Stout not heretofore convey'd as aforesaid and above by these Presents bargained and sold unto the said Joseph Hayward his Heirs and Assigns for ever tot eh only proper Use and Behoof of the said Joseph Hayward his Heirs and Assigns forever To have and to hold the One other equal and undivided half Part of all the said Rest Residue and Remainder of the aforesaid Tract of Land Stout not heretofore conveyed as aforesaid and above by these Presents bargained and sold unto the said Jacob Hayward his Heirs and Assigns forever to the only proper Use and Behoof of him the said Jacob Hayward his Heirs and Assigns for ever And the said Roger Randall for himself his Executors Administrators and every of ^them^ Doth covenant promise grant and agree to and with the said Joseph Hayward and Jacob Hayward their several and respective Heirs and Assigns by these Presents That he the said Roger Randall and his Heirs the said above by these Presents bargained and sold Rest Residue and Remainder of the aforesaid Tract of Land Stout (above) |
