671 Ex.d This Indenture made the fifth Day of May in the Year of our Lord Christ seventeen hundred and seventy four ^Between^ Benjamin Binney of Kent County in Maryland and Mary his Wife (Grandaughter of James Smith late of the said County deceased) of the one Part and John Beale Bordley of the Part Witnesseth that the said Benjamin Binney and Mary his Wife for and in Consideration of the sum of two hundred and forty Pounds Sterling Money of Great Britain to them in Hand paid by the said John Beale Bordley the Receipt whereof they hereby acknowledge and therefrom do hereby release and acquit the said John Beale Bordley Have given granted bargained and sold aliened released and confirmed and by these Presents they the said Benjamin Binney and Mary his Wife do give grant bargain and sell alien release and confirm unto the said John Beale Bordley and his Heirs all those Tracts Pieces or Parcels of Land of the said Mary or of the said Benjamin or of the said Benjamin and Mary situate and being in kent County and the one called or known by the Name of Birthright (being Part of a Tract called Partnership) and the other called or known by the Name of Stepney and all other the Lands and Real Estate whatsoever of the said Mary or of the said Benjamin or of the said Benjamin and Mary in Kent County or else where in Maryland together with the Houses Buildings Improvements Orchards Woods Advantages and Appurtenances whatsoever thereto belonging or appertaining and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every Part thereof and all the Estate Right Title Interest Use Trust Property and Claim of the said Benjamin and Mary or either of them in or to the aforesaid Lands and Premisses with their and every of their Appurtenances To have and to hold all and singular the ^aforesaid^ Lands and Premisses with their Appurtenances hereby bargained and sold or meant or mentioned so to be to the said John Beale Bordley and his Heirs to the only proper Use and Behoof of the said John Beale Bordley and his Heirs and Assigns for ever and to or for no other Use Intent or Purpose Provided always and it is the true Meaning of these Presents that if the said Benjamin Binney and Mary his Wife do well and truly pay or cause to be paid to the said John Beale Bordley his certain Attorney Executors Administrators or Assigns the full Sum of two hundred and forty Pounds Sterling Money of Great Britain at or before the fifth Day of May next ensuing the Date of these Presents with legal Interest for the same then and such Case the Indenture shall be void but otherwise to remain in full Force And the said Benjamin Binney doth covenant for himself and his Heirs with the said John Beale Bordley his Executors Administrators and Assigns that he the said Benjamin and Mary will well and truly pay or cause to be paid to the said John Beale Bordley (his) |
