664 Assigns paying the said one thousand Pounds Sterling or so much thereof as may be necessary to the aforesaid Caleb Dorsey his Executors Administrators or Assigns on the said Account being stated and decreed or otherwise settled as aforesaid and if so much shall not be found necessary to be paid to the aforesaid Caleb Dorsey then after Payment of what thereof may be necessary on his the said Bartholomew Booth his heirs or Assigns paying the Residue of the said Sum of one thousand Pounds Sterling to the aforesaid Edward Gaunt to be applied according to the said Deed in Trust to him excepting nevertheless and in Trust for the aforesaid Fielder Gaunt his Heirs and Assigns as to one convenient Way for him and themselves and his and their Servants Carriages and Cattle of all Kinds whereby to pass from the Lands of him the said Fielder Gaunt to the South Mountain and from the South Mountain to the Lands of the aforesaid Fielder Gaunt in through by and upon the same Lands so to be held in Trust for the aforesaid Bartholomew Booth his Heirs and Assigns And as to touching and concerning all the Residue of the said Lands with their Appurtenances and also all the said Negroes and the Increase of the said Female Negroes In Trust after the said mortgage shall be discharged by an Application of the said one thousand Pounds Sterling or such Part thereof as may be necessary to the Payment and Discharge thereof if the same shall be sufficient or if the same shall not be fully sufficient then after and upon the said Fielder Gaunt and Edward Gaunt or either of them their or either of their Heirs Executors Administrators or Assigns paying the Deficiency to the aforesaid Caleb Dorsey his Executors Administrators or Assigns or if such Deficiency shall be advanced by the said Bartholomew Booth on Repayment thereof with Interest to the aforesaid Bartholomew Booth his Executors Administrators or Assigns by Sale of such or so many of the said Negroes at public Vendue in Frederick Town for ready Money as shall raise such Deficiency and Interest clear of all Charges of such sale that the said William Deakins Thomas Johns & Adam Stewart their Heirs Executors Administrators and Assigns will convey all the same Residue of the Lands aforesaid with their Appurtenances and also all the said Negroes or such of them as shall not be sold at Vendue as aforesaid and the Increase of the said Female Negroes to the aforesaid Edward Gaunt his Heirs Executors Administrators & Assigns upon the Trust and for the Purposes mentioned and contained in the said Deed from the said Fielder Gaunt to the aforesaid Edward Gaunt But if the said Bartholomew Booth shall advance and pay any Sum of Money over and beyond the said Sum of One thousand Pounds Sterling for the Satisfaction and Discharge of the Mortgage aforesaid to the said Caleb Dorsey and the said Negroes with the Increase aforesaid shall not raise Money sufficient to reimburse the Difference between the said (one) |
